ORDINANCE NO. 41-00 BY:Corrigan, FitzGerald, George, Seel ie, Skindel 1. AN EMERGENCY ORDINANCE to enact Chapter 772 of the Lakewood Codified Ordinances, entitled "Business Operations" for the purposes of regulating business operations for a twenty-four hour period. WHEREAS, Twenty-Four Hour Businesses affect the health, safety, and moral and general welfare of the residents of the City of Lakewood; and WHEREAS, Twenty-Four Hour Businesses are not currently regulated within the City of Lakewood; and WHEREAS, the City of Lakewood seeks to regulate Twenty-Four Hour Businesses in order to limit the affects of said business on the health, safety, moral and general welfare of the residents of the of the City of Lakewood; and WHEREAS, the City of Lakewood wishes to enact an ordinance regulating Twenty-Four Hour Businesses; and WHEREAS, an emergency exists to provide for the immediate preservation of the public peace, property, health, safety and welfare in the City. BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. Purpose. It is the purpose of this chapter to regulate Twenty-Four Hour Businesses in the City of Lakewood to promote the health, safety, morals, and general welfare of the citizens of the City of Lakewood. Section 2. That Chapter 772 of the Codified Ordinances, Business Operations, as set forth below is hereby adopted to promote and protect the health, safety, moral and general welfare of the citizens of the City of Lakewood, and for the various purposes set forth therein. Section 3. That Chapter 772, Business Operations, is hereby enacted to read as follows: 772 Business Operations 772.01 Closing Hours a) No person, being the owner or in charge or control of any store or other place of business, located within a C-1 or C-3 commercially zoned district as defined by the Zoning Code of this City, including but not limited to all permitted or conditionally permitted, commercial and retail uses and having an entrance, exit, parking lot, loading dock or show window within 250 feet of any one-family, two-family or multi-family district, as defined by the Zoning Code of this City, shall transact any business in such store or place of business, or cause or permit the store or place of business to be open for the transaction of business after 12:00 a.m. or before 6:00 a.m. of any day. b) No person, being the owner or in charge or control of any store or other place of business, located within a C-2 commercially zoned district as defined by the Zoning Code of this City, including but not limited to all permitted or conditionally permitted, commercial and retail uses, shall
