ORDINANCE NO. 41-00 BY:Corrigan, FitzGerald, George, <br /> Seel ie, Skindel 1. <br /> AN EMERGENCY ORDINANCE to enact Chapter 772 of the Lakewood <br />Codified Ordinances, entitled "Business Operations" for the purposes of <br />regulating business operations for a twenty-four hour period. <br /> <br /> WHEREAS, Twenty-Four Hour Businesses affect the health, safety, <br />and moral and general welfare of the residents of the City of Lakewood; and <br /> <br /> WHEREAS, Twenty-Four Hour Businesses are not currently regulated <br />within the City of Lakewood; and <br /> <br /> WHEREAS, the City of Lakewood seeks to regulate Twenty-Four Hour <br />Businesses in order to limit the affects of said business on the health, safety, <br />moral and general welfare of the residents of the of the City of Lakewood; <br />and <br /> <br /> WHEREAS, the City of Lakewood wishes to enact an ordinance <br />regulating Twenty-Four Hour Businesses; and <br /> <br /> WHEREAS, an emergency exists to provide for the immediate <br />preservation of the public peace, property, health, safety and welfare in the <br />City. <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. Purpose. It is the purpose of this chapter to regulate Twenty-Four <br />Hour Businesses in the City of Lakewood to promote the health, safety, morals, <br />and general welfare of the citizens of the City of Lakewood. <br /> <br />Section 2. That Chapter 772 of the Codified Ordinances, Business <br />Operations, as set forth below is hereby adopted to promote and protect the <br />health, safety, moral and general welfare of the citizens of the City of <br />Lakewood, and for the various purposes set forth therein. <br /> <br />Section 3. That Chapter 772, Business Operations, is hereby enacted to <br />read as follows: <br /> <br />772 Business Operations <br /> <br />772.01 Closing Hours <br /> <br />a) No person, being the owner or in charge or control of any store or <br />other place of business, located within a C-1 or C-3 commercially zoned <br />district as defined by the Zoning Code of this City, including but not limited <br />to all permitted or conditionally permitted, commercial and retail uses and <br />having an entrance, exit, parking lot, loading dock or show window within <br />250 feet of any one-family, two-family or multi-family district, as defined by <br />the Zoning Code of this City, shall transact any business in such store or <br />place of business, or cause or permit the store or place of business to be <br />open for the transaction of business after 12:00 a.m. or before 6:00 a.m. of <br />any day. <br /> <br />b) No person, being the owner or in charge or control of any store or <br />other place of business, located within a C-2 commercially zoned district as <br />defined by the Zoning Code of this City, including but not limited to all <br />permitted or conditionally permitted, commercial and retail uses, shall <br /> <br /> <br />
