772.04 Appeal Process <br /> <br /> Any owner or operator of a store or other place of business located in <br />a C-1, C-2 or C-3 district pursuant to subsections (a) & (b) who desires to <br />operate between the hours of 12:00 a.m. and 6:00 a.m., may apply to the <br />Planning Commission for a Conditional Use Permit, pursuant to section <br />1171.03. No Conditional Use Permit shall be issued unless the Planning <br />Commission finds that the Applicant's proposed use is consistent with the <br />criteria defined in sections 1173.02(b), 1129.14, and 1161.03. <br /> <br />772.05 Penalty <br /> <br /> Whoever violates any provision of this chapter is guilty of a fourth <br />degree misdemeanor for a first offense and a misdemeanor of the first <br />degree for each subsequent offense. <br /> <br />Section 4. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an <br />open meeting of this Council, and that all such deliberation of the Council <br />and of any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal requirements. <br /> <br />Section 5. This ordinance is hereby declared an emergency measure for the <br />reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> <br />approved: <br /> <br />Clerk <br /> <br /> <br />
