ORDINANCE NO. 44-00 BY: Corrigan, FitzGerald, George, Roth, Seelie, Skindell, Smi AN EMERGENCY ORDINANCE requesting Council's SDeciflc approval of and author'~ing the Mayor to enter into a lease for property located at 13614-16 Madison Avenue, Lakewood, Ohio for use by the Division of Youth ("Division") in the Department of Hu man Services, in accordance with Lakewood Codified Ordinance §111.04(a)(4). WHEREAS, the Division of Youth is currently located at 13616 Madison Avenue; and WHEREAS, the Division of Youth has been operating at said location on a month-to- month basis since the expiration of its prior lease and it is in the best interest of the City and the Department of Human Services, Division of Youth to enter into a written lease agreement which will give the Division of Youth the stability and continuity necessary to its continued daily · operation; and WHEREAS, this Ordinance constitutes an emergency measure as it provides for the daily operation of the Department of Human Services, Division of Youth. Now Therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. Lakewood City Council hereby authorizes the Mayor to enter into a Lease Agreement for the Lease of Property consisting of approximately three thousand (3,000) square feet of office area located at 13614-16 Madison Avenue for a term of eighteen (18) months with two additional option terms of one year each, at the option of the City, a total sum not to exceed thirty-two thousand four hundred dollars ($32,400.00) per year payable in monthly installments of two thousand seven hundred dollars ($2,700.00). Section 2. Lakewood City Council hereby specifically approves the Lease Agreement by and between Sandra L. Athanas, 1253 Hathaway Avenue, Lakewood, Ohio and the City of Lakewood, Ohio, 12650 Detroit Avenue, Lakewood, Ohio (attached hereto as Exhibit "A"). Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an e pen meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the prea robie hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the eadiest period allowed by law.
