PLACED Ob <br />2ND READING 9/18/00. <br /> <br />ORDINANCENO. 45-00 <br /> <br /> BY: Corrigan, FitzGerald, <br />George, Roth, Seelie, Skindell, SmJ <br /> <br /> AN EMERGENCY ORDINANCE fixing the compensation of the Clerk of the Lakewood <br />Municipal Court, the time and method of payment <br /> <br /> WHEREAS, the Municipal Court Act, Revised Code Section 1901.31 provides that the <br />legislative authority of this municipality shall fix the annual salary of the Clerk of Courts, and <br /> <br /> WHEREAS, the Act further provides that the compensation of the Clerk shall be paid <br />three-fifths from the City Treasury and two-fifths from the Treasury of the County in which the <br />City is located and, <br /> <br /> WHEREAS, the ordinance constitutes an emergency measure providing for the usual daily <br />operation of a municipal department in that in the interest of public service, welfare, and safety, it is <br />necessary to fix the compensation of the Clerk and direct the time and method of payment thereof, <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1 That the compensation of the Clerk of the Lakewood Municipal Court is hereby <br />fixed at Seventy Seven Thousand Nine Hundred Fifty Dollars per annum effective April 1, 2000. <br /> <br /> Section 2. That the Director of Finance is hereby authorized and directed to pay three- <br />fifths of the compensation of the Clerk as herein fixed, from the City Treasury in semi-monthly or in <br />equal installments every two weeks. <br /> <br /> Section 3. That Ordinance no. 35-99 adopted October 19, 1999 and all other ordinances <br />or parts of ordinances inconsistent herewith shall be and are hereby repealed. <br /> <br /> Section 4. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberation of this Council and any of its committees that resulted in such formal <br />action were in meeting open to the public in compliance with all legal requirements. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency measure for the <br />reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of <br />ail members elected to Council, it shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> <br />President <br /> <br />~Cle k <br /> <br /> <br />
