ORDINANCENO. 46-00 BY:Corrigan, FitzGerald, George, Roth, Seelie, Skindell, Smit AN EMERGENCY ORDINANCE fixing the compensation of the Probation Officer of the Lakewood Municipal Court and the time and method of payment. WHEREAS, the Municipal Court Act, Revised Code Section 1901.33 provides that the legislative authority of a municipality shall fix the compensation of the Probation Officer appointed by the Judge of a Municipal Court and, WHEREAS, this ordinance constitutes an emergency measure prodding for the usual daily operation ora municipal department in that in the interest of public serv/ce, welfare and safety, it is necessary to fix the compensation of the said Probation Office and direct the time and method of payment thereof, now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the compensation of the Probation Officer of the Lakewood Municipal Court is hereby fixed at the aggregate sum of Forty Two Thousand Dollars per annum effective April 1, 2000. Section 2. That the Director of Finance is hereby authorized and directed to pay said compensation of the Probation Officer as herein fixed, fi-om the City Treasury in semi-monthly installments of equal installments every two weeks. Section 3. That Ordinance No. 36-99 adopted October 19, 1999 and all, other ordinances or parts of ordinances inconsistent herewith shall be and are hereby repealed. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal actions were in meeting open to the public in compliance with all legal requirements. Section 5. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor, otherwise, it shall take effect and be in force after the earliest period allowed by law.
