Please substitute for Ordinance NO. 72-00 <br />Placed on 1st reading and referred to the <br />Committee of the Whole 12/4/00 <br /> <br />ORDINANCE NO. 72-00 BY: Corrigan, FitzGerald, <br /> George, Roth, Seelie, Skindell, Smith. <br />AN EMERGENCY ORDINANCE authorizing the Finance Director of the City of <br />LakewOod to forward funds in an amount not to exceed $13,000.00 (thirteen thousand dollars) <br />to the Northeast Ohio Public Energy Council (NOPEC) for the purpose of paying for the City of <br />Lakewood's portion of the "opt-out" mailing as required by Section 4928.20 of the Ohio <br />Revised Code. <br /> <br /> WHEREAS, Section 4928.20 of the Ohio Revised Code requires that each eligible <br />consumer be given the opportunity to "opt-out" of the City's aggregation program; and <br /> <br /> WHEREAS, in order to meet the requirements of Section 4928.20 of the Ohio Revised <br />Code each eligible consumer in the City of Lakewood will be mailed a form allowing them to <br />"opt-out" of the City's aggregation program; and <br /> <br /> WHEREAS, City Council recently passed an ordinance authorizing the City's <br />participation in NOPEC; and <br /> <br /> WHEREAS, NOPEC will coordinate the design, printing and mailing of the "opt-out <br />forms; and <br /> <br /> WHEREAS, it is anticipated that said monies will be recouped from NOPEC at such <br />time that a electdc provider is selected through an RFP process; and <br /> <br /> WHEREAS¢ this ordinance is declared to be an emergency measure which is <br />necessary for the immediate preservation of the public peace, property, health and safety and <br />for the further reason that it provides for immediate steps necessary to the a.q.qre.qation <br />proqram. Now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. This Council authorizes the Finance Director of the City of Lakewood to <br />forward funds to NOPEC in an amount not to exceed $;13,000.00 (thirteen thousand <br />dollars) for the mailing of the "opt-out" process as required by Section 4928.20 of the <br />Ohio Revised Code to the Citizens of Lakewood. <br /> <br />Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were adopted in an open meeting of this' Council, and <br />that all such deliberation of the Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br /> <br />Section 3. That this ordinance is hereby declared to be an emergency measure for the <br />reasons stated in the preamble hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect and be in force immediately upon <br /> <br /> <br />
