transporter or by governmental restriction. Lessee agrees to make every attempt to make use of <br />existing pipelines to transport natural gas to the gas transporter. It is understood by Lessee that <br />the installation or relocation of any production equipment, pipelines, regulators, and meters to <br />areas outside o£ the existing wellhead vault shall require written approval of LesSor, which <br />approval shall not be unreasonably withheld. <br /> <br /> 9. FENCIING/LANDSCAPING. Lessee agrees to fence all equipment, including <br />well-heads and meters on said premises, and, additionally, landscape such equipment to the <br />reasonable satisfaction of Lessor so that it is obscure from the view of passersby. Said <br />landscaping may be in the form of "recessing" of the equipment and, additionally, pines and/or <br />shrubs shall be planted and maintained in a surrounding fashion. However, no fencing or <br />landscaping shall be installed in such a manner so as to restrict the access of equipment <br />necessary to the operation of the well. Should Lessee fail to maintain the landscaping to the <br />reasonable satisfaction of Lessor, Lessor shall have the right, at Lessor's option, to maintain the <br />landscaping at Lessee's cost. <br /> <br /> 10. LESSER INTEREST, In case the Lessor owns a lesser interest in the above <br />described premises than the entire or undivided fee simple therein, then the royalties, delay <br />rentals and other payments herein provided for shall be paid to the Lessor only in the proportion <br />which such interest bears to the whole and undivided fee. <br /> <br /> I 1. APPORTIONlVIENT OF PAYMENTS. If the leased premises shall hereafter be <br />conveyed into separate tracts, the premises nevertheless shall continue to be operated as one <br />lease of`the premises, and all rentals, royalties and payments provided for shall be treated as an <br />entirety and shall be divided among, and paid to, such separate owners in the proportion that the <br />acreage owned by each such separate owner bears to the entire leased acreage of the premises. <br /> <br /> 12. OWNERSHIP CHANGE. No change or division in ownershiP of Lessee's <br />interest in this Lease shall operate to enlarge the obligations or diminish the rights of Lessor. No <br />change or division in ownership in the leased premises or in the rentals or royalties hereunder <br />shall be binding on the Lessee until Lessee has received written notice from the Lessor and has <br />been furnished with tho written transfer of a cea'tiffed copy thereof'. <br /> <br /> 13. ASSIGNMENT. The Lessee shall have'the right to assign and transfer the within <br />lease in whole or in part in accordance with Paragraph 1 $ hereof. Any assignment by Lessee <br />shall be to a qualified oil and gas well operating company, and shall require written consent of <br />Lessor, which shall not be unreasonably withheld. Lessor agrees that, when and if the within <br />lease is assigned by Lessee, the Lessee herein shall have no further obligations subsequent to the <br />date of' assignment. The Lessor further grants to the Lessee, for the protection of` the Lessee's <br />interest hereunder, the right to pay and satisfy any claim or lien against the Lessor's interest in <br />the premises herein leased and thereupon to become subrogated to the rights of' such claimant or <br />lien holder, and the fight to direct payment of all rentals and royalties to apply on the payment of <br />any existing liens on the premises. <br /> <br />3 <br /> <br /> <br />
