(b) The Building Commissioner shall not issue any cerUficate of occupancy for a <br />new building, S[TUcture or addition prior to the plugging of an abandoned gas or oil well <br />located on the same !o~. Furthermore, no person Shall occupy a new building, si~ucture <br />or addEion before an abandoned gas or oil well located on the same lot is plugged. <br /> <br /> (c) No person shall abandon or cause to be abandoned and/or plugged a gas or <br />oil well without first notifying the Building Commissioner, in writing on a form provided <br />by the Commissioner. The wr'~ten notice shall include a plot plan indicating thereon the <br />exact location of the well to be abandoned and plugged and include the measurement <br />of the distance of the well from any sl~ucture on the same and abutting Iot~ and the <br />measurement of the distance of the well from at least two abutting property lines. The <br />fee for filing, recording and notifying the City is five dollars ($5.00). <br /> <br /> (d) Upon receipt of said notification, the Building Commissioner. shall forward <br />said notification to the Fire Chief of the Lakewood Division of Fire who shall cause an <br />inspection of said well to be conducted pdor to the plugging of the well. <br /> <br /> 729.08 MAINTENANCE OF WELLS; LEAKAGE <br /> No person being the owner of land or lessee of gas or oil well dghts upon the <br />land of another, shall permi~ a gas or oil well to become deteriorated, damaged or in <br />such disrepair as to cause leakage of gas or oil. Such leakage of gas or oil shall <br />cons~Jb~ a nuisance, and repair shall be made forthwith. <br /> <br />729;09 PRF_SCP,[B[NG METHODS WHERE PROV[S[ONS ];NEFFECTWE. <br />[f the provisions of this chapter canno~ be applied, or if applied, would be <br />ineffective in carrying out the protection which this chapter is meant to give, then the <br />Building Commissioner, the Fire Chief or the Ohio Department of Natural Resources, <br />Division of Mineral Resources Management may designate the me~hod to be used. <br /> <br /> 729.99 PENALTY <br /> Whoever violates any of the provisions of this chapter is guilty of a misdemeanor <br />of the first degree. <br /> <br /> Section 2. ~[t is found and determined tha~ all formal actions of this Coundl <br />conceming and relating to the passage of this ordinance were adopted in an open <br />meeting of this Coundl, and that all'such deliberations of this Council and of any of its <br />commk'tees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />PRESIDENT <br /> <br /> <br />
