PLACED ON <br />2ND READING 4/16/01). <br /> <br />ORDINANCE NO. 19-01 BY: Corrigan, FitzGerald, George, <br /> Roth, Seelie, Skindell, Smith. <br /> <br /> AN ORDINANCE dissolving the Recreational Programs and Facilities Self- <br />Insurance Agreement C'Agreement") and fund between the City of Lakewood <br />and the Board of Education of the Lakewood City School District C'Board") for claims <br />arising out of or connected with the operation of the Lakewood Munidpal Pools, <br />Winterhurst Ice Rink and other Athletic Programs and repealing Ordinance No. 42-87 <br />which authorized the Agreement. <br /> <br /> WHEREAS, the Board is no longer charged With the operation of Winterhurst Ice <br />Rink; and <br /> <br /> WHEREAS, this year the City and the Board have entered into a new agreement <br />for the operation of the Lakewood Munidpal Pools; and <br /> <br /> WHEREAS, as part of said Agreement, the City has agreed to provide insurance <br />coverage to the employees of the Board who are charged with the operation of the <br />Munidpal Pools; and <br /> <br /> WHEREAS, said insurance has been obtained and insurance is already in place <br />for the athletic programs listed in the Agreement, thereby making the joint insurance <br />fund dispensable. Now Therefore, <br /> <br />BE 1T ORDAINED BY' THE Crl'Y OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That Ordinance No. 42-87, adopted 3une 1, 1987, currently reading <br />as follows: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and <br />directed to enter into an Agreement with the Board of Education of the <br />Lakewood City School District providing for the sharing of expenses <br />relating to the administration, defense and payment of any claims made <br />for injuries or damages arising out of the operation of the recreational <br />programs conducted by the Board of Education and Recreation <br />Department, said Agreement to be substantially in the form of Exhibit "A" <br />attached hereto and made a part hereof as if fully rewritten herein. <br /> <br />is hereby repealed. <br /> <br /> Section 2. This Council finds that the 1987 RecreatiOnal Programs and Facilities <br />Self-Insurance Agreement by and between the City of Lakewood CCity'3 and the Board <br />of Education of the Lakewood City School District ("Board") (attached hereto as ~Exhibit <br />1'~) is no longer necessary to govern payment of claims arising out of or connected with <br />the operation of the Munidpal Swimming Pools and is hereby dissolved. <br /> <br /> Section 3. In light of the 2001 Agreement by and between the C~:y and the <br />Board for the Operation of the Outdoor Pools, authorized by Resolution No. 7542-01, <br />and the purchase of insurance .for the Operation of Municipal Swimming Pools, this <br />Council finds that it is in the best interest of the City to dissolve the Self-Insurance Fund <br />established for the payment of claims and related expenses arising out of or connected <br />with the operation of the Munidpal Swimming Pools, Winterhurst Ice Rink and other <br />recreational programs and hereby dissolves said Self-Insurance Fund. <br /> <br /> Section 4. It is found and.determined that all formal actions of this Coundl <br />concerning and relating to the passage of this ordinance were adopted in an open <br /> <br /> <br />
