W~EREAS, pursuant to R.C. Section 2744.08(A) (2)(a) the <br />Board and the City may each reserve such funds as each deems <br />appropriate in a special fund which each may establish in <br />connection with the establishment and maintenance of a <br />self-insurance program by each political subdivision; and <br /> <br /> WHEREAS, pursuant to R.C. Section 2744.08(A) (2) (b) the <br />City and the Board may mutually agree their self-insurance program <br />will be jointly administered in the manner set forth herein; and <br /> <br /> WHEREAS, pursuant to R.C. Section 2744.081[c) the City <br />and the Board may each issue general obligation bonds or notes, in <br />anticipation of such bonds, to provide for the reserve in the <br />special fund authorized by R.C. Section 2744.08(~ (2) (a); and <br /> <br /> WHEREAS, the City and the Board are acting pursuant to <br />the aforesaid sections of the Revised Code in entering into this <br />Agreement and are not establishing a "joint self-insurance pool" <br />as defined in R.C. Section 2744.081(A); and <br /> <br /> WHEREAS, the parties believe it promotes the health and <br />welfare of the citizens of the City to continue the operation of <br />the Recreational Programs and Recreational Facilities and desire <br />to set forth a comprehensive agreement providing for the sharing <br />of expenses relating to the administration, defense and, where <br />appropriate, payment of any claims made for injuries or damages <br />arising out of the maintenance and continuation of such <br />activities; and' <br /> <br />-3- <br /> <br /> <br />
