ORDINANCE NO. 26-oz <br /> <br /> BY: Corrigan, FitzGerald, <br />George, Roth, Seelie, Skindell, Smith. <br /> <br /> AN EMERGENCY ORDINANCE adjusting appropriations for expenditures in the <br />General Fund for the fiscal year ending December 31, 2001. <br /> <br /> WHEREAS, the Director of Planning and Development has been authorized to <br />accept and expend Cuyahoga County Brownfield Grant dollars in the amount of Five <br />Thousand Dollars ($5,000.00); and <br /> <br /> WHEREAS, as a result of those dollars, the fund balance is sufficient to support <br />appropriations below; and <br /> <br /> WHEREAS, these funds are necessary to pay for a professional services <br />agreement with Hull and Associates, Inc. for the underground storage tank investigation <br />at the property located at 11726-28 Detroit Avenue and 1385-87 Hird Avenue, <br />Lakewood, Ohio; and <br /> <br /> WHEREAS, this Coundl by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CI-FY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that environmental <br />contamination is an urgent matter of public concern. Now Therefore, <br /> <br />BE 1T ORDAINED BYTHE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Director of Finance is hereby authOrized and directed to <br />increase appropriations in the following fund by the amount stated below: <br /> <br />General Fund $5,000 <br /> <br /> Section 2. That the Director of Finance be and he is hereby authorized to draw <br />checks upon the City depositories for the amounts appropriated in this ordinance <br />whenever claims are presented properly, approved by the head of the department for <br />which the indebtedness is incurred, providing the President of CoUncil shall approve all <br />claims for the City Coundl. <br /> <br /> Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings.open to the public in <br />compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservaUon of the public peace~ property, <br />health, safety and welfare in the City and for the usual daily operaUon of the City for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it <br />receives the affirmative vote of at least five (5) of its members elected to Council, this <br />ordinance shall take effect and be in force immediately upon its adoption by the Coundl <br /> <br /> <br />
