ORDINANCE NO. 27-01 BY: Corrigan, F. itzGerald, <br /> George, Roth, Seelie, Skindell, Smith. <br /> <br /> AN EMERGENCY, ORDINANCE adjusting contracting authority of the Mayor to <br />enter into a contract for professional engineering services for an underground storage <br />tank investigation in accordance with the Administrative Code of the City of Lakewood. <br /> <br /> WHEREAS, the City of Lakewood has contracted with Hull and Associates, Inc, for <br />professional services in the amount of Four Thousand Four Hundred Eighty Dollars <br />($4,480.00) for professional services for Phase I of an environmental assessment of the <br />properties located at 11726-28 Detroit Avenue and 1385-87 Hird Avenue, Lakewood, <br />Ohio and funded by Community Development Block Grant dollars; and <br /> <br /> WHEREAS, as a result of those services, Hull and Assodates, InC. has determined <br />that an underground tank was installed at some point on the subject property; and <br /> <br /> WHEREAS, additional work, in the form of soil and groundwater sampling and <br />analysis (Phase II) will be required in order to ascertain the extent if any of soil and/or <br />groundwater contamination on said property; and <br /> <br /> WHEREAS, said additional work will not exceed Five Thousand Dollars <br />($5,000.00); and <br /> <br /> WHEREAS, Cuyahoga County has Brownfield Grant Funds available for said <br />project; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible asset forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE cI'rY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that environmental <br />contamination is an urgent matter of public concern. Now Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, SI'ATE OF OHIO <br /> <br /> Section 1. That the Mayor of'the City of Lakewood is hereby authorized and <br />directed to enter into an addendum amending the Contract between the City of <br />Lakewood and Hull and Associates, Inc. for additional professional services in the form <br />an undergrOund storage tank investigation (Phase II) for the property located at 11726- <br />28 Detroit Avenue and 1385-87 Hird Avenue, Lakewood, Ohio for an additional amount <br />not to exceed Rye Thousand Dollars ($5,000.00) and a total contract price not to <br />exceed Nine Thousand FOur Hundred Eighty Dollars ($9,480.00). <br /> <br /> Section 2. It is found and determined that all formal actions of this Coundl <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby deClared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it <br /> <br /> <br />
