<br />AN ORDINANCE TO ENACT CHAPTER 777 OF THE LAKEWOOD CODIFIED ORDINANCES, ENTTTLED
<br />"LXCEN$ING FOR SEXUALLY ORIENTED BUSINESSES" FOR THE PURPOSES OF REGULA'I~NG
<br />SEXUALLY ORIENTED BUSINESSES.
<br />
<br /> WHEREAS, the City of Lakewood Council finds that Sexually Oriented Businesses in the
<br />City of Lakewood require special supervision from public safety and health agencies in order to
<br />protect and preserve the health, safety and welfare of the patrons of such businesses as well as
<br />citizens of the City; and
<br />
<br /> WHEREAS, numerous cities haVe studied the effects of Sexually Oriented Businesses on
<br />the neighborhoods and areas in which those businesses are located; and
<br />
<br /> WHEREAS, files available to the members of the City Council in the office of the Clerk of
<br />Council contain copies of the "Adult Entertainment Study" dated November 1994 conducted by the
<br />New York City Department of Planning; "Adult Entertainment Businesses in Indianapolis, An
<br />Analysis" dated February 1984, conducted by the Department of Metropolitan Development of the
<br />City of Indiana oolis; and the "Report of the Attorney General's Working Group on the Regulation of
<br />Sexually Oriented Businesses" dated 3une 6, 1989, conducted by the Attorney General for the
<br />State of N innesota: and
<br />
<br /> WHEREAS, the "Adult Entertainment Study" of the City of New York contains summaries of
<br />impact studies from the cities of Islip, New York; Los Angeles, California; Indianapolis, Indiana;
<br />Whittier, California; Austin, Texas; and Phoenix, Arizona; along with Manatee County, Florida; New
<br />Hanover County, North Carolina; and the State of Minnesota; and
<br />
<br /> WHEREAS, a copy of such summaries have been made available to each member of the
<br />City Council for review in conjunction with consideration of the Ordinance; and
<br />
<br /> WHEREAS, these numerous studies conclude, based on documented evidence, that
<br />Sexually Oriented Businesses have negative secondary effects such as increased crime rates,
<br />decreased property values, curtailed retail trade and deterioration of the quality of urban life; and
<br />
<br /> WHEREAS, the City Council finds that Sexually Oriented Businesses are frequently used for
<br />unlawful sexual activities, including prostitution; and
<br />
<br /> WHEREAS, the City Council desires to minimize and control these adverse effects and
<br />thereby protect the health, safety, and welfare of the citiZenry, protect the citizens from increased
<br />crime, preserve the quality of life, preserve the property values and character of surrounding
<br />neighborhoods, and deter the spread of urban blight; and
<br />
<br /> WHEREAS, the City Council has determined that location criteria alone do not adequately
<br />protect the health, safety and general welfare of the people of this City; and
<br />
<br /> WHEREAS, Sexually Oriented Businesses require special supervision from public safety
<br />agencies .in order to protect and preserve the health, safety and welfare of the patrons of such
<br />businesses and the citizens of the City; and
<br />
<br /> WHEREAS, the City Council finds that Sexually Oriented Businesses and adUlt motels
<br />frequently are used for unlawful sexual activities, including prostitution and public sex acts; and
<br />
<br /> WHEREAS, the concern over sexually transmitted diseases is a legitimate health concern of
<br />the City which demands reasonable regulation of Sexually Oriented Businesses in order to protect
<br />the health and well-being of the citizens; and
