AN EMERGENCY ORDINANCE adjusting appropriations for expenditures in the Water Fund and the Wastewater Treatment Fund for the fiscal year ending December 3i, 2001. WHEREAS, the appropriation increase will provide the funding for the watermain replacement and sewer repairs needed prior.to the resurfadng of Hilliard Road; and WHEREAS, the appropriation increase is supported by the existing fund balance of the Water Fund and the issuance of bond anticipation notes; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the eadlest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CTrY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of munidpal departments in that these projects are necessary for the completion of the Hilliard RJ~ad resurfadng project. Now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Director of Rnance is hereby authorized and directed to increase appropriations in the following funds by the amount stated below: Water Fund Wastewater Treatment Fund $1,100,000 $870,000 Section 2. That the Director of Rnance be and he is hereby authorized to draw checks upon the City depositories for the amounts appropriated in this ordinance whenever claims are presented properly, approved by the head of the department for which the indebtedness is incurred, providing the President of Council shall approve all claims for the City Council. Section 3. It is found and determined that all formal actions of this Coundl concerning and relating to the passage of this ordinance were adopted in an open meeting of this Cound[, and that all such deliberation of the Coundl and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this ordinance is hereby declared to be an emergency measure necessary for the Immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its members elected to Cound[, this ordinance
