PLACED ON IST READING & REFERRED TO <br />COMMITTEE OF THE WHOLE 9/17/01. <br />2nd Read 1.0/1/01 <br /> <br />ORDINANCE NO. 36-01 BY: Corrigan, FitzGerald, George, <br /> Roth, Seelie, Skindell, Smith. <br /> <br /> AN EMERGENCY ORDINANCE fixing the compensation of the Clerk of the Lakewood <br />Municipal Court, the time and method of payment. <br /> <br /> WHEREAS, the Municipal COurt Act, Revised Code Section 1901.31 provides that the <br />legislative authority of this municipality shall fix the annual salary of the Clerk of Courts, and <br /> WHEREAS, the Act further provides that the compensation of the Clerk shall be paid <br />three-fif[hs from the City Treasury and two-fifths from the Treasury of the County in which the <br />City is located and, <br /> <br /> WHEREAS, the ordinance constitutes an emergency measure providing for the usual daily <br />operation of a municipal department in that in the interest of public service, welfare, and safety, it is <br />necessary to fix the compensation of the Clerk and direct the time and method of payment thereof, <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> Section 1. That the compensation of the Clerk of the Lakewood Municipal Court is hereby <br /> fixed at Eighty One Thousand Eight Hundred Forty Dollars per annum effective April 1, 2001. <br /> Section 2. That the Director of Finance is hereby authorized and directed to pay three- <br /> fifths of the compensation of the Clerk as here'm fixed, from the City Treasury in semi-monthly or in <br /> equal installments every two weeks. <br /> <br /> Section 3. That Ordinance no. 45-00 adopted October 3, 2000 and all other ordinances or <br /> parts of ordinances inconsistent herewith shall be and are hereby repealed. <br /> Section 4. It is found and determined that all formal actions of this Council concerning <br /> and relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br /> that all such deliberation of this Council and any of its committees that resulted in such formal <br /> action were in meeting open to the public in compliance with all legal requirements. <br /> Section 5. That this ordinance, is hereby declared to be an emergency measure for the <br /> reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of <br /> all members elected to Council, it shall take effect and be in force immediately upon its adoption <br /> and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period <br /> allowed by law. <br /> <br /> ~esident <br /> · <br /> <br /> <br />
