Exhibit B <br /> <br />MORTGAGE <br /> <br />The CITY of LAKEWOOD, OHIO, a municipal corPoration organized and existing under the laws <br />of the State of Ohio (the Mortgagor), whose current mailing address is 40 Severance Circle, <br />Cleveland Heights, Ohio 44118, for the Dollars paid or to be paid pursuant to the Public Entity <br />Loan Agreement between the Mortgagor and the Mortgagee dated October 16, 2001, relating to <br />real property described in Exhibit A hereto (the Loan Agreement), hereby grants, with mortgage <br />covenants, to the COUNTY OF CUYAHOGA, OHIO, a county organized and existing under the <br />laws of the State of Ohio (the Mortgagee), whose current mailing address is County Administration <br />Building, Room 432, 1219 Ontario St. Cleveland, Ohio 44114, the real property described .in <br />Exhibit A attached hereto and madea part hereof. <br /> <br />This mortgage is given, upon the statutory cOndition, to secure the payment of dollars loan by the <br />Mortgagee to the Mortgagor pursuant to the Loan Agreement with interest as provided in a note of <br />the same date. <br /> <br />"Statutory condition" is defined in section 5302.14 of the Revised Code and provides generally <br />that, if the mortgagor pays the principal and interest secured by this mortgage, performs the other <br />obligations secured by this mortgage and the conditions of any prior mortgage, .pays all the taxes <br />and assessments, maintains insurance against fire and other hazards, and does not commit or suffer <br />waste, then this mortgage shall be void. Notwithstanding the foregoing, this mortgage shall be <br />released upon conveyance of the project site and payment to the County pursuant to Section 4.
