WHEREAS, the Citizens Advisory Committee has recommended substantial changes to the Fiscal Year 2001 CDBG Budget to move unspent fund to the Madison Pool House ProJect; and WHEREAS, these proposed renovations to the Madison Pool House will make the structure ADA Accessible and address the safety concerns of this structure prior to next year's swimming season; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in AR'I'ZCLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEW~D, and that it is necessary for the usual daily operation of municipal departments in that this project must be started as soon as possible in order to have it complete by the 2002 swimming season. Now Therefore/ B IT ORDAINED BY THE C1TY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Public Works is hereby authorized an directed to engage architectural and/or engineering firms to provide professional services in the design and preparation of specifications and contract administration and to advertise for bids and enter into a contract with the lowest and best bidder in accordance with the Administrative Code of the City of Lakewood for the following Building and Fadlities improvement, contract not to exceed the specified amount shown, except as hereinafter provided: Madison Pool House ............................................. $500,000 Section 2. That the Director of Public Works is hereby authorized and directed to enter into a contract as set forth above in the amount not to exceed the specified amount without further action from Council; and to enter into a contract in excess of specified amounts only upon consent of Council evidence by adoption of a resolution specifying the authorized amount. Section 3. It is found and determined that all formal actions of this Coundl concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. This ordinance is hereby declared to be an emergency measure for the providing for the usual daily operations of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its members elected to Council, this ordinance shall take effect and be in force immediately upon its adoption by the Coundl and approval by the
