Please Substitute for Ordinance No. 49-01, <br />Placed on 1st Reading and Referred to <br />Committee ~f the Whp!Q qn [Q/[/~[) <br />Placed on 2nd Reading [0/[5/0[. <br /> <br />ORDINANCE NO. 49-01 BY: Corrigan, FitzGerald, George, Roth, <br /> nJe l, S th. <br /> AN EMFRGENCY ORDINANCF to amend Chapter 149, Employment PFovisions of <br />the Codified Ordinances of the City of Lakewood. <br /> <br />WHEREAS, Chapter 149 has been not been updated since 1995; and <br /> <br /> WHEREAS, through the process of collective bargaining, many of the <br />employment provisions .for members of the collective bargaining units have changed; <br />and <br /> <br /> WHEREAS, City employees should have some consistency in the benefits of their <br />em ployment throughout the various departments and divisions within the City; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the eadiest date possible as set forth in ARTICLE III. SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD. and that it <br />is necessary to provide for the daily operation of municipal departments in that it is <br />necessary to provide notification to employees and service providers regarding certain <br />changes contained herein in order to facilitate said changes. Now Therefore. <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> 149.01 <br /> For the <br />follows: <br /> (a) <br /> <br /> DEFZNITJ:ONS. <br /> purposes of this chapter, certain words and phrases are defined as <br /> <br /> "Hourly employee" means all persons who furnish labor or personal <br /> service to the City and are compensated therefor by wages fixed, <br /> computed or paid on an hourly basis and paid directly by the City, except <br /> employees who furnish labor to the City Hospital and are cOmpensated <br /> from the Hospital Fund. <br />(bi "Week" means the period beginning at 12:01 a. m. Monday and ending at <br /> 12:00 midnight the following Sunday. <br />(c) "Work week" means the period in a week dudng which houry employees <br /> shall be available for work. It regularly shall be within the period frOm <br /> Monday to the following Friday, both .inclusive. It shall be forty hours <br /> except that in any week in which there occurs a holiday, as hereina~cer <br /> defined, it shal be thirty-two hours. Nothing herein contained shall be <br /> construed to limit the power of the City as employer to require overtime <br /> labor when necessary. <br />(d) "Work day" means the period in any day during which hourly employees <br /> shall be available for work. It regularl'y shall be eight hours in each <br /> consecutive twenty-four hour period from Monday to Fdday, both <br /> inclusive. Nothing herein contained shall be construed to limit the power <br /> of the City as employer to require overtime labor when necessary. <br />(e) "Full-fime~ permanent hourly employee" means an hourly employee who <br /> has been employed by the City full time at least sixty consecutive days, <br /> but shall exclude Lakewood Hospital employees, temporary employees, <br /> .seasonal employees, police cadets, school guards and public works <br /> inspectors. <br />(fi "Division head" means the person who is in charge of the operation of any <br /> division named in the City Charter, the work of which is performed in any <br /> part by one or more hourly employees. <br />(g) "Regular time" means the rate of Pay for work performed by an hOurly <br /> employee during a workweek and 'dUring a work day. <br />(hi "Overtime" means the rate of pay for work performed by an hourly <br /> employee in excess of a work day or a work week, or for work performed <br /> by such employee on Saturday, Sunday or any holiday as hereina~cer <br /> defined. In the event an employee's regular work week is other than <br /> Monday through. Friday, he shall not be paid overtime unless such <br /> emplOyee works in excess of forty hours per week or eight hours per day. <br /> <br /> <br />
