ORDINANCE NO. <br /> <br />56-01 <br /> <br />Please Substitute For ordinance No. 56-01, Placed <br />on 1st Reading and Referred to Public Works <br />Committee on 11/5/01, Placed on 2nd Reading <br />11/19/01 and Referred to Public Works Committee. <br /> <br />BY: Corrigan, Roth, Seelfe, Smith. <br /> <br /> AN EMERGENCY ORDINANCE to amend § 905.07, ANIMALS, set forth in Chapter <br />905, PARKS, of the Codified Ordinances of the City of Lakewood thereby adding a new <br />provision to prohibit the feeding of geese~ other wild animals and/or birds so as to <br />discourage and otherwise deter the continued presence of geese at Lakewood Park. <br /> <br /> WHEREAS, there has been an ever-increasing and intolerable nuisance with the <br />presence of geese and the resultant geese droppings in Lakewood Park creating both a <br />health and safety hazard; and <br /> <br /> WHEREAS, members of the public who frequent the park, have been and <br />continue to feed the geese and thereby encourage the continued presence of the geese <br />in the park; and <br /> <br /> WHEREAS, in addressing the need to deter the presence of geese in Lakewood <br />Park and further to protect the public in the use of the parks and the facilities located <br />therein and/or to protect and preserve such parks, amendment to the above ordinance <br />is necessary; and <br /> <br /> WHEREAS, this Coundl by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the eadiest date possible as set forth in ARTICLE III, SECTIONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE cl-rY OF LAKEWOOD, and that <br />immediate action is necessary in order to preserve the health, safety and welfare of the <br />general public~ Now, therefore, <br /> <br />BE IT ORDAINED BY THE CI-I'Y OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That §905.07 of the Codified Ordinances of the ab/of Lakewood, <br />currently reading as follows: <br /> <br /> 905.07 ANIMALS. <br /> <br /> (a) Animals Prohibited. No dogs or other animals shall be allowed within the <br />Parks. <br /> <br /> (b) Molestinq Animals. No person shall use any weapon, stick, stone or <br />missile of any kind in the destruction or injury of or to, or in such manner as to disturb <br />or molest, any wild or domestic fowl, animal or fish propedy within the park limits. <br /> <br />shall be and is hereby amended to read as follows: <br /> 905.07 ANIMALS. <br /> <br /> (a) Animals Prohibited, No dogs or other animals shall be allowed within the <br />parks,.with, the exception .of those animals specifically authorized by the Director of <br />Public WORKS. <br /> <br /> (b) Feedino of Animals Prohibited. No person shall feed or otherwise provue <br />food to geese, other-wild animals and/or birds within the parks. <br /> <br /> (c) Molesting AnimalS. No person shall use any weapon, stick, stone <br />missile of any kind in the destruction or injury of or to, or in such manner, as to distUrb <br />or molest, any wild or domestic fowl, animal or fish properly within the park limits. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council. <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal actions were in meetings open to the public, in <br />compliance with all legal requirements. <br /> <br /> <br />
