G..EN.CY_ORDI.N_AN.C_E ,to,..a. mend .Sec~.ion 149.16, Military Leave; <br /> mpensation, or tne LaKewood [:oairled ominances for the purpose of granting City of <br />Lakewood employees additional benefits as have been granted to employees of state <br />agendes. <br /> <br /> WHEREAS, on November 20, 2001, Ohio Governor Bob Taft approved Senate Bill <br />16~, granting additional benefits to state employees who are called to active military <br />duty; and <br /> <br /> WHEREAS, this Council .by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest datepossible as set forth in ARTICLE I11, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CTTY OF LAKEWOOD, and that it is <br />necessary to provide for the usual daily operation of municipal departments in that <br />employees of the City of Lakewood have already been called to active military duty. <br />Now, therefore, <br /> <br /> BE TI' ORDAINED BY THE C1TY OF LAKEWOOD, 5--i'ATE OF OHIO <br /> <br /> Section 1. That Section 149.16, Military Leave; Compensation, currently reading <br />as follows: <br /> <br /> 149.16 MILITARY LEAVE; COMPENSATION. <br /> (a) All full-time, permanent, hourly employees and all annual, salaried <br /> employees, not covered b~/a collective bargaining agreement shall be granted leaves of <br /> absence for military duty in accordance with State and federal law. <br /> <br /> (b) Any such employee of the City who is temporarily called to active duty (e. <br />g., summer training) shall be granted a leave of absence for the duration of such active <br />duty and shall be paid for a .period of not more than one hundred seventy-six (176) <br />hours in any one calendar year and shall accumulate vacation, longevity andsick leave <br />credit dudng the period of such leave. <br /> <br /> (c) An employee called or ordered to the uniform service for a period in <br />excess of one hundred and seventy six (176) hours in any calendar year as a result of <br />an execution order of the President of the United States or an Act of Congress, is <br />entitled to leave o_f ab .~.,n, ce and receive pay for each bi.-,w_ eekly pay period, as follows: <br /> 1. i ne airrerence between the employee s regular gross monthly wages <br /> and the. .sum o.f. th.e. emplpyee's g.ross uniform pay and allowances <br /> receivea auring mat pi-weekly period; or <br /> · 2. Five hundred dollars ($500.00). <br />The employee shall receive the greater .amount stat~l above, provided that such <br />payments do not result in an amount that exceeds the employee's gross wages for the <br />pay period as a City employee. <br /> <br />is hereby amended to read as follows: <br /> <br />149.16 MILITARY LEAVE; COMPENSATION. <br /> <br /> (a) All full-time, permanent, hourly employees and all annual, saladed <br />employees shall be granted leaves of absence for .military duty in accordance with State <br />andfederal law. <br /> <br /> (b) AnY such employee of the City who is temporarily called to active duty (e. <br />g., summer training) shall be granted a leave of absence for the duration of such active <br />duty and shall be paid for a period of not more than one hundred seventy-six (176) <br />hours in any one calendar year and shall accumulate vacation, longevity andsick leave <br />credit during the period of such leave. <br /> <br /> (c) Any full-time, permanent, hourly employee and any annual, salaried <br />employee who is called or ordered to the uniformed services for longer than a month, <br />or each calendar year in which the employee performed service in the uniformed <br /> <br /> <br />
