ORDINANCE NO: lO4-O2 COMMITTEE OF THEW HOLE 4~15~02.PLACED ON 2ND READING 5/6/02. 8¥: Corrigan, Dunn, FitzGerald, George, Roth, Seelie, Skindell. AN EMERGENCY ORDINANCE adjusting apPropriations for expenditures in the General Fund for the fiscal year ending December 31, 2002 for the purposes of professional consulting services in connection with the preparation of a Community Development Plan for the "West End" District in accordance with Chapter 153 of the Codified Ordinances of the City of Lakewood. WHEREAS, pursuant to Section 153,05 of the Codified Ordinances of the City of Lakewood, the Mayor recommended the initiation of the preparation of a Community Development Plan for the "West End" District and to contract with a consultant for preparation of such a Plan; and WHEREAS, the Lakewood Planning Commission on April 2, 2002, unanimously concurred with this recommendation; and WHEREAS, pursuant to Ordinance 103-0z, the Mayor has been authorized to enter into an agreement for professional consultant services on behalf of the City of Lakewood to provide for the preparation of a Community Development Plan for the "West End" District of Detroit Avenue, Lakewood, Ohio; and .. WHEREAS, appropriations are needed, not to exceed Forty-Rve Thousand Dollars ($45,000.00) for such consultant services; and WHEREAS, this Council by a vot~ of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in AR'I/CLE HI, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, to provide for the immediate preservation of the of the public property, health and safety, and to provide for the timely analysis of this ImportaDt commerdal district. NOW, THEREFORE, BE IT ORDAINED BY THE CTI'Y OF LAKEVVOOD, STATE OF OHIO: Section 1. That the Director of Rnance is hereby authorized and directed to increase appropriations in the following fund by the amount stated below: General Fund $4~000.00 Section 2. That the Director of Rnance be and she is hereby authorized to draw checks upon the City depositories for the amounts appropriated in this ordinance whenever claims are presented properly, approved by the head of the department for Which the indebtedness is incurred, providing the President of Council shall approve all daims for the City Council. Section 3. [t is found and determined that all formal actions of this Coundl concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and any of its committees that resulted in such formal actions, were in meetings open to the public in Compliance with all legal requirements. Section 4. This Ordinance is hereby declared to be an emergency measure for the reasons set forth and defined in the preamble of this Ordinance, and provided it receives the affirmative vote of at least five (5) of its members elected to Council, this Ordinance shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor; otherwise it shall take effect and be in force a~cer the earliest period allowed by law.
