ORDINANCE NO: lO4-O2 <br /> <br />COMMITTEE OF THEW HOLE 4~15~02.PLACED ON <br />2ND READING 5/6/02. <br /> 8¥: Corrigan, Dunn, FitzGerald, <br /> George, Roth, Seelie, Skindell. <br /> <br /> AN EMERGENCY ORDINANCE adjusting apPropriations for expenditures in the General Fund for the <br />fiscal year ending December 31, 2002 for the purposes of professional consulting services in connection <br />with the preparation of a Community Development Plan for the "West End" District in accordance with <br />Chapter 153 of the Codified Ordinances of the City of Lakewood. <br /> <br /> WHEREAS, pursuant to Section 153,05 of the Codified Ordinances of the City of Lakewood, the <br />Mayor recommended the initiation of the preparation of a Community Development Plan for the "West End" <br />District and to contract with a consultant for preparation of such a Plan; and <br /> <br /> WHEREAS, the Lakewood Planning Commission on April 2, 2002, unanimously concurred with this <br />recommendation; and <br /> <br /> WHEREAS, pursuant to Ordinance 103-0z, the Mayor has been authorized to enter into an <br />agreement for professional consultant services on behalf of the City of Lakewood to provide for the <br />preparation of a Community Development Plan for the "West End" District of Detroit Avenue, Lakewood, <br />Ohio; and .. <br /> <br /> WHEREAS, appropriations are needed, not to exceed Forty-Rve Thousand Dollars ($45,000.00) for <br />such consultant services; and <br /> <br /> WHEREAS, this Council by a vot~ of at least five (5) members elected thereto determines that this <br />ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible <br />as set forth in AR'I/CLE HI, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, to provide for the immediate preservation of the of the public property, health and safety, and <br />to provide for the timely analysis of this ImportaDt commerdal district. NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE CTI'Y OF LAKEVVOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Rnance is hereby authorized and directed to increase <br />appropriations in the following fund by the amount stated below: <br /> <br />General Fund $4~000.00 <br /> <br /> Section 2. That the Director of Rnance be and she is hereby authorized to draw checks upon <br />the City depositories for the amounts appropriated in this ordinance whenever claims are presented <br />properly, approved by the head of the department for Which the indebtedness is incurred, providing the <br />President of Council shall approve all daims for the City Council. <br /> <br /> Section 3. [t is found and determined that all formal actions of this Coundl concerning and <br />relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and any of its committees that resulted in such formal actions, were in <br />meetings open to the public in Compliance with all legal requirements. <br /> <br /> Section 4. This Ordinance is hereby declared to be an emergency measure for the reasons set <br />forth and defined in the preamble of this Ordinance, and provided it receives the affirmative vote of at least <br />five (5) of its members elected to Council, this Ordinance shall take effect and be in force immediately upon <br />its adoption by the Council and approval by the Mayor; otherwise it shall take effect and be in force a~cer <br />the earliest period allowed by law. <br /> <br />Adopted: "~ .').~;,, ,7-od 2 ~ <br /> President <br /> <br />Approved: <br /> <br /> <br />
