BY: <br /> <br />Corrigan, Dunm, FitzGerald, George, <br />Roth, Seelie, Skfndell. <br /> <br /> AN EMERGENCY ORDINANCE providing for the submission to the electors <br />of the City of Lakewood, an amendment to Article II, Section 4, Mayor's <br />Appointment Power, of the Second Amended Charter of the City of Lakewood to <br />grant Council approval authority of the Mayor's appointments. <br /> <br /> WHEREAS, in November; 2000, the electors of the City c~f LakeWood <br />adopted the Second Amended Charter; and <br /> <br /> WHEREAS, with the adoption of the Second Amended Charter, Council's <br />approval power of'some of the Mayor's. appointments was removed; and <br /> <br /> WHEREAS, pursuant to the Second Amended Charter of the City of <br />Lakewood and the Constitution of the State of Ohio, the Council has determined <br />to authorize and direct the submission to the electors of the City of Lakewood of <br />the proposed .amendment to the Second Amended Charter, at the general <br />election to be held on Tuesday, November 5, 2002, which election is not less <br />than 60 nor more than 120 days from the effective date of this Ordinance; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this ordinance is an emergency measure, and that this. <br />ordinance shall take effect at the earliest date possible as set forth in ARTICLE <br />III, SECTONS 10 and :1.3 of the SECOND AMENDED CHARTER OF THE cTrY OF <br />LAKE'WOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that this Ordinance must be transmitted to the <br />Cuyahoga County Board of Elections not less than 60 nor more than 120 days <br />from the November 5, 2002 election. Now Therefore <br /> <br /> BE irT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEVVOOD, STATE <br />OF OHIO; 'DA/O-THIRDS OF THE MEMBERS OF COUNCIL, CONCURRING: <br /> <br /> Section 1. That this Coundl hereby determines to authorize and direct <br />the submission to the electors of the City of Lakewood at the general election to <br />be held at the usual places of voting in the City on Tuesday, November 5, 2002, <br />the proposed amendment to Article II, Section 4 as stated below. <br /> <br /> Section 2. The Board of Elections of Cuyahoga County is hereby <br />directed to submit the following question to the electors of the City at the <br />general election on November 5, 2002: <br /> <br />Shall Article II, Section 4, Mayofs Appointment Power, of the Second' <br />Amended Charter of the City of Lakewood, Ohio be amended to read as <br />follows? <br /> <br /> The Mayor shall appoint, with approval of Coundl, and may <br />remove, if and when the office Is created, the Director of Public Safety, <br />and shall appoint, with the al~l~roval of Ceuncil, and may remove the <br />Director of Public Works, the Director of Law, the Director of Rnance, and <br />the Director of Planning and Development, the Director of Human Services <br />and the Health Commissioner. The Mayor shall make all other <br />appointments under the provisions of this Charter not herein otherwise <br />provided for by general law or ordinance; such appointeeS shall serve until <br />removed by the Mayor or until their' respective successors are appointed <br />and qualified. <br /> <br />.(Language in bold would be Inserted.) <br /> <br /> <br />
