ORDINANCE NO. 131-02 BY:corri§an, EitzGerald, Ro/h, Seelie, Skindell AN ORDINANCE to submit to the electorate of the City of Lakewood an Amendment to the Second Amended Charter of the City of Lakewood. WHEREAS, pursuant to Article XV[[I, Section 9 of the Ohio Constitution petitions have been presented to Lakewood City Coundl requesting an amendment to the Second Amended Charter of the City of Lakewood; and WHEREAS, Lakewood City Council is required by the Ohio constitution to submit the question of whether to amend the Charter to the electors; and WHEREAS, Lakewood City coundl has no discretion to change or otherwise amend the proposed Charter Amendment presented by petition; and WHEREAS, the Clerk of Coundl, through the Cuyahoga county Board of Elections, has verified that the petitions contain a suffident number of · signatures. Now, therefore, BE 1T ORDAINED BY THE COUNCIL OF THE ~ OF LAKEWOOD, STATE OF OHIO, Section 1. That the question of an Amendment to the Second Amended Charter of the City of Lakewood shall be submitted to the voters at the election to be held Tuesday, November 5, 2002. Section 2. That the question shall be submitted to the voters in the form presented by the petitions below, which is as follows: ORDINANCE NO. -02 AN ORDINANCE FOR THE SUBMZSSION TO THE ELECTORATE OF AN AMENDMENT TO THE MUNICIPAL CHARTER RELATIVE TO ARTICLE XD(, ELECTIONS, TO PROVIDE FOR NON-PARTLSAN ELEC'I/ONS AND DECLARING AN EMERGENCY. WHEREAS, pursuant~to Article XXIII, Section 6 of the Amended Charter of the City of Lakewood and Artide XVIII, Section 9 of the Ohio constitution petitions have been presented to Lakewood City Council requesting an amendment to the Amended Charter of the City of Lakewood; and WHEREAS, Lakewood City Council is required by the Amended.Charter of the City of Lakewood and the Ohio Constitution to submit the question of whether to amend the Charter to the electors; and WHEREAS, Lakewood City Council has no discretion to change or otherwise amend the Charter Amendment presented by petition; and 'NOW THEREFORE, BE TI' ORDAINED BY THE COUNCIL OF THE ClTY OF LAKEWOOD, STATE OF OHIO: Section 1. There shall be submitted to the electors of the City of Lakewood at a munidpal election, to be held as is provided by law, the question of amending Article XIX, Elections, to provide for non-partisan elections to be held in all candidate elections in the future in the City of Lakewood.
