Corrigan, Dunn, Fal. tzGeral,-t, George, Roth, <br /> <br /> AN EMERGENCY ORDINANCE authoriz)ng the Mayor to enter into an agreement <br />w)th the Northeast Ohio Pub))c Energy Coundi {NOPEC} for the provision of Gas <br />AggregaUon Services in the Ob/of Lakewood with opt-out provisions pursuant to Ohio <br />Revised Code §4929.26and pursuant to the approval of the e~ectors of the City of <br />Lakewood on May 7, 2002. <br /> <br /> WHEREAS, the City has been given a deadline to enter into an agreement with <br />NOPEC of 3uly 31, 2002; and <br /> <br /> WHEREAS, In order for the residents of the City of Lakewood to realize savings <br />this heating season as the result of an aggregaUon program, the City of Lakewood <br />should take advantage of the offer from NOPEC; and <br /> <br /> WHEREAS, NOPEC has negotiated an agreement with Interstate Gas Supply for a <br />five percent (5%) discount on the utiliUes standard gas rate; and <br /> <br /> WHEREAS, this CoUncil by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and' <br />13 of the SECOND AMENDED CHARTER OF THE C1TY OF LAKEWOOD, and that it is <br />necessary to provide for the usual daily operation of municipal departments in that this <br />agreement must be entered into and returned to NOPEC no later than 3uly 31, 2002. <br />Now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. This Council hereby authorizes the Mayor to enter into an <br />agreement with the Northeast Ohio Public Energy Council (NOPEC), a copy of. which is <br />on file with the Clerk of Council) for the provision of Gas Aggregation Services in the <br />City of Lakewood with opt-out provisions pursuant to Ohio Revised Code §4929.26 and <br />pursuant to the approval of the electors of the City of Lakewood on May 7, 2002. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeUng of this Council, and that all such deliberaUons of this Council <br />and of any of its committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance Is hereby declared to be an emergency <br />measure necessary for the usual daily operation of the Clty for the reasons set forth and <br />defined in the preamble to this ordinance, and provided it receives the affirmative vote <br />of at least five (5) of Its members elected to Council, this ordinance shall take effect and <br />be in force Immediately upon its adopUon by the Coundl and approval by the Mayor <br />otherwise, it shall take effect and be in force after the earliest period allowed by law. <br /> <br />Approved: ~~-~' <br /> / <br /> <br />Pib, F_SIDENT <br /> <br /> <br />
