ORDINANCE NO: 134-02 Corrigan, Dunn, FitzGerald, Roth, Seelie AN EMERGENCY ORDINANCE adjusting appropriations for expenditures in the General Fund and the Hospital Fund for the fiscal year ending December 31, 2002 for the purpose of taking measures for West Nile Virus prevention. WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance Is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTZCLE III, SECTONS 10 and 13 ' of the SECOND ANENDED CHARTER OF THE CTrY OF LAKEWOOD, and that it is necessary for the Immediate preservation of the public property, health and safety, and to provide for the usual dally operation of munidpal departments in that these appropriation adjustments are necessary to take prophylactic steps against the spread of the West Nile Virus. Now Therefore, BE Tr ORDAINED BY THE Ct-fY OF LAKEWOOD, STATE OF OHIO Section 1. That the Director of Finance is hereby authorized and directed to decrease appropriations in the following fund by the amount. stated below: General Fund $30,000 Section 2. That the Director of Rnance is hereby authorized and directed to increase appropriations in the following fund by the amount stated below: Hospital Fund $70,000 Section 3. That the Director of Rnance is hereby authorized to draw checks upon the City depositories for the amounts appropriated in this ordinance whenever claims are presented, propedy approved by the head of the department for which the Indebtedness is Incurred, providing the President of Council or his/her designees shall approve all claims of the Cib/Coundl. Section 4. In accordance with Article III, Section 12, of the Charter of the Qb/ of Lakewood, Coundl hereby determines that the manner of gMng notice of the passage of this ordinance is to be by posting copies hereof for a period of not less than fifteen (15) days in not less than five (5) of the most public places in the Qb/, which places have been determined by Council in Ordinance No. 55-59. Section 5. I~ is found and determined that all formal actions of this Coundl concerning and relating to the passage of this ordinance were adopted in an open meeting of this Coundl and of any of its committees, that resulted in such formal actions, were in meetings open to the public in compliance with all legal requirements. Section 6. That this ordinance is hereby declared to be an emergency measure necessary for the Immediate preservation of the public peace, property, health~ safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmaUve vote of at least five (5) of its members elected to Coundl, this ordinance
