Second Reading&.Kefe~ed to ~he Co~m/ttee <br />.of the Whole $/20J02. <br /> <br />ORDINANCE NO: 134-02 <br /> <br />Corrigan, Dunn, FitzGerald, <br />Roth, Seelie <br /> <br /> AN EMERGENCY ORDINANCE adjusting appropriations for expenditures in the <br />General Fund and the Hospital Fund for the fiscal year ending December 31, 2002 for <br />the purpose of taking measures for West Nile Virus prevention. <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance Is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTZCLE III, SECTONS 10 and 13 ' <br />of the SECOND ANENDED CHARTER OF THE CTrY OF LAKEWOOD, and that it is <br />necessary for the Immediate preservation of the public property, health and safety, and <br />to provide for the usual dally operation of munidpal departments in that these <br />appropriation adjustments are necessary to take prophylactic steps against the spread <br />of the West Nile Virus. Now Therefore, <br /> <br />BE Tr ORDAINED BY THE Ct-fY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That the Director of Finance is hereby authorized and <br />directed to decrease appropriations in the following fund by the amount. <br />stated below: <br /> <br />General Fund $30,000 <br /> <br />Section 2. That the Director of Rnance is hereby authorized and <br />directed to increase appropriations in the following fund by the amount <br />stated below: <br /> <br />Hospital Fund $70,000 <br /> <br /> Section 3. That the Director of Rnance is hereby authorized to draw <br />checks upon the City depositories for the amounts appropriated in this ordinance <br />whenever claims are presented, propedy approved by the head of the <br />department for which the Indebtedness is Incurred, providing the President of <br />Council or his/her designees shall approve all claims of the Cib/Coundl. <br /> <br /> Section 4. In accordance with Article III, Section 12, of the Charter of <br />the Qb/ of Lakewood, Coundl hereby determines that the manner of gMng <br />notice of the passage of this ordinance is to be by posting copies hereof for a <br />period of not less than fifteen (15) days in not less than five (5) of the most <br />public places in the Qb/, which places have been determined by Council in <br />Ordinance No. 55-59. <br /> <br /> Section 5. I~ is found and determined that all formal actions of this Coundl <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Coundl and of any of its committees, that resulted in such formal <br />actions, were in meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 6. That this ordinance is hereby declared to be an emergency measure <br />necessary for the Immediate preservation of the public peace, property, health~ safety <br />and welfare in the City and for the usual daily operation of the City for the reasons set <br />forth and defined in the preamble to this ordinance, and provided it receives the <br />affirmaUve vote of at least five (5) of its members elected to Coundl, this ordinance <br /> <br /> <br />
