Lakewood for the purpose of escalating the penalty where an <br />individual causes physical harm to a police officer and to remain consistent with the <br />Ohio Revised Code. <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE 1T ORDAINED BY THE CITY OF LAKEWOOD, S'rATE OF OHIO <br /> <br /> Section 1. That section 525.09, Resisting Arrest, of the Codified Ordinances of <br />the City of Lakewood currently reading as follows: <br /> <br /> 525.09 RESISTING ARREST. <br /> (a) No person, recklessly or by force, shall resist or interfere with a lawful <br />arrest of himse f or another. <br /> <br /> (b) Whoever violates this section is guilty of resisting arrest, a misdemeanor <br />of the second degree. <br /> <br />shall be and is hereby amended to read as follows: <br /> <br /> 525.09 RESISTING ARREST. <br /> (a) No person~ recklessly or by force, shall resist or interfere with a lawful <br />arrest of himself or another. <br /> u,L(~b')~he No person, reckless y or by force, shall resist or interfere with a lawful <br /> person or another p.erson .a.nd, du. ring.the co~urse of o.r a~s~ a result of the <br />arrest <br />resistance or interference, cause pnysica~ narm to a mw enforcement O~T~cer. <br /> <br /> (c) Whoever violates this section is guilty of resisting arrest. A violation of <br />subsection (a) hereof is a misdemeanor of the second degree. A violation of subsection <br />(b) hereof is a misdemeanor of the first degree. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />Adopted: <br /> <br />Mayor <br /> <br /> <br />
