PLACED ON 1ST READING & REFERRED TO THE RULES & <br /> <br />ORDINANCE NO. <br /> <br />37-02 BY: Corrigan, Dunn, Fl=zGerald, <br /> George, Roth, Seelie, Skindell, <br /> <br /> AN ORDINANCE amending section 537.05, Aggravated Menacing, of the Codified <br />Ordinances of the City of Lakewood for the purpose of including harm to another's <br />unborn and to remain consistent with the Ohio Revised Code. <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE Ti' ORDAINED BY THE CTTY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 537.05, Aggravated Menacing, of the Codified <br />Ordinances of the City of Lakewood currently reading as follows: <br /> <br /> 537.05 AGGRAVATED MENACZNG. <br /> (a) No person shall knowinglY cause another to believe that the offender will <br />cause serious physical harm to the person or property of such other person or member <br />of his Immediate family. <br /> <br /> (b) Whoever violates this section is guilty of aggravated menacing, a <br />misdemeanor of the first degree. <br /> <br />shall be and is hereby amended to read as follows: <br /> <br /> 537.05 AGGRAVATED MENACING. <br /> (a) No person shall knowingly cause another to believe that the offender will <br />cause serious physical harm to the person or property of the other person, the other <br />person's unborn, or a member of the other person's Immediate family. <br /> <br /> (b) Whoever violates this section is guilty of aggravated menacing, a <br />misdemeanor of the first degree. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of'this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted-in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />Adopted:~ ~!
