ORDINANCE NO. 38-02 BY: Corrigan,Dunn, George, Roth, <br /> Seelie, Sktndell. <br /> <br /> AN ORDINANCE to amend section 537.055(a)(2}A, Menacing by Stalking, of the <br />Codified Ordinances of the City of Lakewood for the purpose of further defining "pattern <br />of conduct" and to remain consistent with the Ohio Revised Code. <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE TI' ORDAINED BY THE C['FY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 537.055(a)(2)A, Menacing by Stalking, of the Codified <br />Ordinances of the City of Lakewood currently reading as follows: <br />(a)... <br /> (i)... <br /> (2)... <br /> A. <br /> <br />"Pattern of conduct" means two or more actions or incidents dosely <br />related in time, whether or not there has been a prior conviction <br />based on any of those actions or inddents. <br /> <br />shall be and is hereby amended to read as follows: <br /> <br />(1)... <br />(2)... <br /> A. <br /> <br />~Pattem of conduct" means two or more actions or Incidents closely <br />related in time, whether or not there has been a prior conviction <br />based on any of those actions or incidents. Actions or inddents that <br />prevent, obstruct, or delay the performance by a public official, <br />firefighter, rescuer, or emergency medical services person of any <br />authorized act within the public offidal's, firefighter's, rescuer's or <br />emergency medical services person's official capacity may <br />constitute a "pattern of conduct." <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Coundl, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with'all legal requirements. <br /> <br />President of Council <br /> <br />Cie o u~. cl <br /> <br /> <br />
