PLACED ON 1ST READING & REFERRED TO THE <br />RULES & ORDINANCES CMTE 2/19/02. <br /> <br />PLACED ON 2ND READING 3/4/02. <br /> <br />ORDINANCE NO. 40-02 <br /> <br />BY: Corrigan, Dunn, FitzGerald, <br />George, Roth, Seelie, Sktndell. <br /> <br /> AN ORDINANCE to repeal section 537.12, Party Llries to be Yielded in <br />Emergencies, of the CodifiedOrdinances of the City.of Lakewood as party lines no <br />longer exist. <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 537.12, Party Lines to be Yielded in Emergencies, of <br />the Codified Ordinances of the City of Lakewood cu. rrently reading as follows: <br /> <br /> 537.12 PARTY LINES TO BE YIELDED IN EMERGENCIES. <br /> (a) No person shall willfully refuse immediately to yield or relinquish the use <br />of a party line to another person for the purpose of permitting such other person to <br />report a fire or summon law enforcement agencies, ambulance service, medical or other <br />aid in case of emergency. <br /> No person shall ask for or request the use of a party line on the pretext that an <br />emergency exists, knowing that no emergency exists. <br /> As used in this section: <br /> (1) "Party line" means a subscriber's line telephone circuit to which two <br /> or more main telephone stations are connected, each station <br /> having a distinctive ring or telephone number. <br /> (2) "Emergency" means a. Situation in which property or human life is <br /> in jeopardy and in which prompt summoning of aid is essential. <br /> <br />is hereby repealed. <br /> <br /> Section 2. It Is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />corn pliance with all.legal requirements. <br /> <br />Adopted: <br /> <br />Approved:? _~ ~// ~/~ ~-- <br /> <br />President of Council <br /> <br /> <br />
