PLACED ON 1ST READING & REFERRED TO THE <br />RULES & ORDINAB'CES CMTE <br /> PLACED ON 2~° READING 3/4/02. <br /> <br />ORDINANCE NO. 47-02 <br /> <br />BY: Corrigan, Dunn, FitzGerald, <br />George, Roth, Seelie, Skindell. <br /> <br /> AN ORDINANCE to amend section 545,08, Unauthorized Use of Property, of the <br />Codified Ordinances of the City of Lakewood for the purpose of escalating the penalty- <br />where the purpose of committing the offense is to devise or execute a scheme to <br />defraud or obtain property or services and remaining consistent with the Ohio Revised <br />Code. <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE ~ ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 545.08, Unauthorized Use of Property, of the Codified <br />Ordinances of the City of Lakewood currently reading as follows: <br /> <br /> 545.08 UNAUTHORIZED USE OF PROPERTY. <br /> (a) No perso, n shall knowingly use or operate the property of another <br />without the consent of the owner or person authorized to give consent. <br /> <br /> (b) The affirmative defenses contained in Section 545.06(c) are affirmative <br />defenses to a charge under this section. <br /> <br /> (c) Whoever violates this section is guilty of unauthorized use of property, a <br />misdemeanor of the fourth degree, provided the offense does not involve any <br />computer, computer system, computer network, computer software or data. <br /> <br />Shall be and is hereby amended to read as follows: <br /> <br />545.08 UNAUTHORIZED USE OF PROPERTY. <br /> <br /> (a) No person shall knowingly use or operate the property of another <br />without the consent of the owner or person authorized to give consent. <br /> <br /> '(b) The affirmative defenses contained in Section 545.06(c) are affirmative <br />defenses to a charge under this section. <br /> <br />(c) Whoever violates this section is guilty of .unauthorized use of property. <br />Except as provided in subsection (d) hereof, unauthorized use of property is a <br />misdemeanor of the fourth degree. · <br /> <br /> ,. (d)_ If unauthorized use of property is committed'for the purpose of devising <br />'or executin~j a scheme to defraud or to obtain property or services, unauthorized use of <br />property is a misdemeanor of the first degree. <br /> <br /> Section 2. It is found and determined 'that all formal actions of this Council <br />concerning and relating to the passage of this ordi'hance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br /> <br /> <br />
