AN ORDINANCE to amend section 545.09(d), Passing Bad Checks, of the Codified Ordinances of the City of Lakewood for the purpose of increasing the dollar amount of the check or negotiable instrument for the crime to remain a misdemeanor and to remain consistent with the Ohio Revised Code. WHEREAS, this ordinance is necessary for the public health, welfare and safety. Now therefore, BE 1T ORDAINED BY THE C1TY OF LAKEWOOD, STATE OF OHIO Section 1. That section 545.09(d), Passing Bad Checks, of the Codified Ordinances of the City of Lakewood currently reading as follows: (d) Whoever violates this section is guilty of passing bad checks, a misdemeanor of the first degree, provided the check or other negotiable instrument is for the payment of less than three hundred dollars ($300.00) and provided the offender has not previously been'convicted of a theft offense. shall be and is hereby amended to read as follows: (d) Whoever violates this section is guilty of passing bad checks, a misdemeanor of the first degree, provided the check or other negotiable instrument is for payment of less than five hundred dollars ($500.00). Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this .ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
