PLACED ON 1ST READING & REFERRED TO THE RULES <br />ORDINANCES CM~E Z/19f02. <br /> <br />PLACED ON 2~''~ READING 314/02. <br /> <br />ORDINANCE NO, 49-02 BY: Corrigan, Dunn, FitzGerald, <br /> George, RotS, Seelie, Skindell. <br /> <br /> AN ORDINANCE to amend section 545.10(d), Misuse of Credit Cards, of the <br />Codified Ordinances of the City of Lakewood for the purpose of designating the crime, <br />where the retail value of property obtained with the credit card, is less than five <br />hundred dollars ($500) a misdemeanor and remaining consistent with the Ohio Revised <br />Code. <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 545.10(d), Misuse of Credit Cards, of the Codified <br />Ordinances of the City of Lakewood currentJy reading as follows: <br /> <br /> (d) Whoever violates any of the provisions of this section is guilty of misuse of <br />credit cards. Violation of subsection (a), (b)(1) or (c) hereof is a misdemeanor of the <br />first degree if the value of the property or services or the loss to the victim involved in <br />such violation is less than one hundred thousand dollars ($100,000). Violation of <br />paragraph (b)(2), (3) or (4) hereof is a misdemeanor of the first degree if the <br />cumulative resale value of the property and services involved in one or more violations <br />of paragraph (b)(2), (3) or (4) hereof, which violations involve one or more credit card <br />accounts and occur within a pedod of ninety consecutive days commencing on the date <br />of the first violation;is less than three hundred dollars ($300.00) and if the offender has <br />not previously been convicted oft theft offense. <br /> <br />shall be and is hereby amended to read as follows: <br /> <br />(d) Whoever violates any of the provisions of this section is guilty of misuse of credit . <br />cards, a misdemeanor of the first degree, provided that the cumulative retail value of <br />the property and services involved in one or more violations, involving one or more <br />credit cards and occurring within a period of ninety days, is less than five hundred <br />dollars ($500.00). <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council~ and that all such deliberation of the Council and ef any of its <br />committees that resulted in such formal action were in meetings open to the public in. <br />compliance with all legal requirements. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />President of Council <br /> <br />Clerk~o~~ <br />Mayc~r <br /> <br /> <br />
