PLACED ON iST READING & REFERRED TO THE <br />RULES & ORDINANCES CMTE 2/19/02. <br /> <br /> PLACED ON 2'~n READING 3/4/02. <br />ORDINANCE <br /> NO. <br /> 53-02 <br /> BY:corrigan, Dunn, FitzGerald, Geor <br /> Roth, Seelie, Skindell. <br /> <br /> AN ORDINANCE to enact a new seddon 545.20, Cdminal Simulation, of the <br />Codified Ordinances of the City of Lakewood for the purpose of remaining consistent <br />with the Ohio Revised Code. <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE 1T ORDA[NED BY THE'CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That new section 545,20, Criminal' Simulation, of the Codified <br />Ordinances of the City of Lakewood is hereby enacted to read as follows: <br /> <br />545.20 CRIMINAL SIMUtAIION <br /> <br /> (a) No person, with purpose to defraud, or knowing that the person is <br />facilitating a fraud, shall do any of the following:. <br /> (1) Make or alter any object so that it appears to have value because <br /> of antiquity, radty, curiosity, source, or authorship, which it does <br /> not in fact possess; <br /> (2) Practice deception in making, retouching, editing, or reproducing <br /> any photograph, movie film, video tape, phonograph record, or <br /> recording tape; <br /> (3) Falsely or fraudulently make, simulate, forge, alter, or counterfeit <br /> any wrapper, label, stamp, cork, or cap prescribed bythe Liquor <br /> Control Commission under Ohio R.C. Chapters 4301 and 4303, <br /> falsely or fraudulently cause to be made, simulated, forged, altered, <br /> or counterfeited any wrapper, label, stamp, cork, or cap prescribed <br /> §y the Uquor Control Commission under Ohio R.C. Chapters 4301 <br /> and 4303. <br /> Utter, or posses with purpose to utter, any object that the person <br /> knows to have been simulated as provided in subsection (a)(1), (2)' <br /> or (3) of this section. <br /> <br /> (b) Whoever violates this section is guilty of criminal simulation, a <br />misdemeanor of the first degree, provided the loss to the victim is less than five <br />hundred dollars ($500.00). <br /> <br /> Section 2. It is found and determined that all formal actions'of this Council <br />concerning and relating to the passage of this ordinance were adOpted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in' such formal action were in meetings open to the public in <br />com~pliance with all legal requirements. <br /> <br />Adopted:. ~/' <br /> <br />President of'Council <br /> <br />Approved: <br /> <br />Ma~yor <br /> <br /> <br />
