PLACED ON 1ST READING & REFERRED TO THE <br />RULES & ORDINANCES CMTE 2/19/02. <br /> <br />PLACED ON 2ND READ!rNG 3/4/02. <br /> <br />ORDINANCE NO. 57-02 - ' <br /> <br />BY: Corrigan, Dunn, FitzGerald, <br />George, Roth, Seelie, Skindell. <br /> <br /> AN ORDINANCE to enact new section 553.011, Obstructing Streets by Abandoning the <br />Locomotive, of the Codified Ordinances of the City of Lakewood for the purpose of remaining <br />consistent with the Ohio Revised Code, <br /> <br /> WHEREAS, this ordinance is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE IT ORDAINED BY THE Crl'Y OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That new section 553.011, Obstructing Streets by Abandoning the <br />Locomotive, of the Codified Ordinances of the City of Lakewood is hereby created to read as <br />follows: <br /> <br />553.011 OBSTRUCTING STREETS BY ABANDONING THE LOCOMOTIVE <br /> <br /> (a) No railroad company shall obstruct, or permit or cause to be obstructed, a public <br />street, road, or highway, by permitting any part of a train whose crew has abandoned the <br />locomotive to remain across it for longer than five minutes to the hindrance or inconvenience of <br />travelers or a person passing along or upon the street, road, or highway, unless the safety of <br />the train crew requires them to abandon the locomotive. <br /> <br /> (b) Upon the filing of an affidavit or complaint for violation of this section, summons <br />shall be issued to the railroad company pursuant to Ohio R.C. 2935.10(B), which summons shall <br />be served on the regular ticket or freight agent of the company in the county where the offense <br />occurred. <br /> <br /> (c) Whoever violates this section is guilty of a misdemeanor of the first degree and <br />shall be fined five thousand dollars ($5000.00). <br /> <br /> Section 2.' It is found and determined that all formal actions of this Council concerning <br />and relaUng to the passage of this ordinance were adopted in an open meeting of this CounCil,' <br />and that all such deliberaUon of the Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements, <br /> <br />Approved: <br /> <br />· President of Council <br /> <br /> <br />
