Please substitute for Ordinance No. 82-02. <br />(Placed on ist Reading & Referred to the <br />Committee of the Whole 3/18/02, Placed on <br />2nd Reading 4/1/02) <br /> <br />ORDINANCE NO. 82-02 BY: Corrigan, D~nn, FitzGerald, <br /> George, Roth, Seelie, Skindell. <br /> <br /> AN ORDINANCE to amend section 111.01, Departmental PUblic Improvement <br />Contracts, of the Codified Ordinances of the City of Lakewood for the purpose of <br />including language to require not .to exceed language and separate approval of Council <br />for architectural, engineering and design services for contracts other than those relating <br />to street reconstruction projects, induding water main and sewer line replacement <br />projects. <br /> <br /> WHEREAS, currently there is no requirement in section 111.01 of the Codified <br />Ordinances that professional services associated with the construction of public <br />improvements be approved by separate' ordinance. <br /> <br /> WHEREAS, some limit should exist to insure the effident use of public funds. <br />Now therefore, <br /> <br />BI= IT ORDAINED BY THE cTrY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 111.01, Departmental Public Improvement Contracts, <br />of the Codified Ordinances of the City of Lakewood currently reading as follows: <br /> <br /> 111.01 DEPARTMENTAL PUBLIC IMPROVEMENT CONTRACTS. <br /> (a) Contracts for public improvements and work and repairs with respect to <br />public improvements shall be awarded by the Director of Public Works upon approval by <br />Council. Adoption of an ordinance or resolution authorizing the preparation of plans or <br />specifications, an ordinance or resolution authorizing the advertising of request for bids <br />(where bidding shall be required) or any other ordinance or resolution which authorizes <br />or approves the award of contracts, and specifies the limit to be spent, shall constitute <br />the approval of Council required bv Section 3 of Article V of the Charter and this <br />section, except that any contract for an amount which exceeds the amount specified for <br />a line item detailed in the ordinance or resolution shall not be valid or enforceable <br />unless first specifically authorized by a separate resolution of Council. <br /> <br /> (b) 'Contracts described in subsection (a) hereof in excess of seven thousand <br />five hundred dollars ($7,500) shall be awarded by competitive bidding pursuant to <br />Section 111.04 unless competitive bidding is not required pursuant to such section. <br /> <br />shall be and is hereby amended to read as follows: <br /> <br /> 111.01 DEPARTMENTAL PUBLIC IMPROVEMENT CONTRAS. <br /> (a) Contracts for public Improvements and work and repairs with respect to <br />public improvements shall be awarded by the Director of Public Works u .pp. n apj~m, val by <br />Council.
