PLACED ON 1ST READING & REFERRED TO THE <br />COMiMITTEE OF THE WHOLE 3/17/03. <br /> <br />ORDINANCE NO: <br /> <br />29-03 <br /> <br /> BY: Corrigan, Dever, Dunn, <br />FitzGerald, George, Roth, Seelie. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the use of the Economic Development Fund (EDF) <br />Public Investment Program and to enter into a professional services contract in an amount not to <br />exceed Sixty Thousand Dollars ($60,000.00), with Hull & Associates, Inc. for the purposes of <br />conducting Phase II Environmental Assessment activities on the Hinkley Lighting properties located <br />at i2600 and 12750 Berea Road Lakewood, Ohio, as part of a Clean Ohio Grant Fund application <br />to the State of Ohio. <br /> <br /> WHEREAS, it is in the public interest to see that this property owner retains and expands his <br />business in Lakewood and that an environmental assessment and clean-up of the property will be <br />necessary prior to the expansion of the business; and <br /> <br /> WHEREAS, Hinkley Lighting is a Lakewood based manufacturing company that has been in <br />existence since :1922 and in Lakewood for over twenty-five years; and <br /> <br /> WHEREAS, a Phase I Environmental Assessment of the property has been completed by the <br />property owner and concluded that a Phase II Environmental Assessment is necessary; and <br /> <br /> WHEREAS, it was determined that a Phase II Environmental Assessment is a necessary <br />component to a Clean Ohio Grant Fund application to the State of Ohio; and <br /> <br /> WHEREAS, pre-development activities including environmental assessments are eligible <br />activities for funding through the EDF; and <br /> <br /> WHEREAS, the Economic Development Committee convened on March 13, 2003 and, <br />reviewed, and unanimously recommended approval of the request for EDF funds by Hinkley <br />Lighting, Inc. through the Public Investment Program (PIP); and <br /> <br /> WHEREAS, as an authorized use of the City of Lakewood's entitlement allocation of federal <br />Community Block Grant dollars, the Economic Development Fund (EDF) was established and <br />approved by Lakewood City Council on December 2, :1996. The intent of the EDF is to promote <br />business investment and redevelopment in identified areas of Lakewood for the purpose of <br />supporting Lakewood's competitiveness and attractiveness as a location for new businesses and <br />the expansion of existing businesses; and <br /> <br /> WHEREAS, the Public Investment Program (PIP) was established and approved by <br />Lakewood City Council on .lune 2, :1997 as a means for implementing the EDF in order to provide <br />needed and appropriate assistance and support to companies investing in Lakewood that would <br />foster redevelopment efforts to increase jobs, generate new tax revenue and provide for physical <br />improvements in Lakewood; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto determines <br />that this ordinance is an emergency measure, and that this ordinance shall take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTIONS 10 and :[3 of the SECOND AMENDED <br />CHARTER OF THE CITY OF LAKEWOOD, to provide for the immediate preservation of the public <br />property, heath and safety, and that it is necessary to conduct a Phase II Environmental <br />Assessment in a timely manner to apply to the Clean Ohio Fund. Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section :1. The Council of the City of Lakewood hereby authorizes the use of the <br />Economic Development Fund (EDF) Public Investment Program and to enter into a professional <br />services contract in an amount not to exceed Sixty Thousand Dollars ($60,000.00), with Hull & <br />Associates, Inc. for the purposes of conducting Phase II Environmental Assessment activities on <br />the Hinkley Lighting properties located at :12600 and :12750 Berea Road Lakewood, Ohio, as part <br />of a Clean Ohio Grant Fund application to the State of Ohio; <br /> <br />Page 1 of 2 <br /> <br /> <br />
