PLACED ON 1ST READING & REFERRED TO THE COMiMITTEE OF THE WHOLE 3/17/03. ORDINANCE NO: 29-03 BY: Corrigan, Dever, Dunn, FitzGerald, George, Roth, Seelie. AN EMERGENCY ORDINANCE authorizing the use of the Economic Development Fund (EDF) Public Investment Program and to enter into a professional services contract in an amount not to exceed Sixty Thousand Dollars ($60,000.00), with Hull & Associates, Inc. for the purposes of conducting Phase II Environmental Assessment activities on the Hinkley Lighting properties located at i2600 and 12750 Berea Road Lakewood, Ohio, as part of a Clean Ohio Grant Fund application to the State of Ohio. WHEREAS, it is in the public interest to see that this property owner retains and expands his business in Lakewood and that an environmental assessment and clean-up of the property will be necessary prior to the expansion of the business; and WHEREAS, Hinkley Lighting is a Lakewood based manufacturing company that has been in existence since :1922 and in Lakewood for over twenty-five years; and WHEREAS, a Phase I Environmental Assessment of the property has been completed by the property owner and concluded that a Phase II Environmental Assessment is necessary; and WHEREAS, it was determined that a Phase II Environmental Assessment is a necessary component to a Clean Ohio Grant Fund application to the State of Ohio; and WHEREAS, pre-development activities including environmental assessments are eligible activities for funding through the EDF; and WHEREAS, the Economic Development Committee convened on March 13, 2003 and, reviewed, and unanimously recommended approval of the request for EDF funds by Hinkley Lighting, Inc. through the Public Investment Program (PIP); and WHEREAS, as an authorized use of the City of Lakewood's entitlement allocation of federal Community Block Grant dollars, the Economic Development Fund (EDF) was established and approved by Lakewood City Council on December 2, :1996. The intent of the EDF is to promote business investment and redevelopment in identified areas of Lakewood for the purpose of supporting Lakewood's competitiveness and attractiveness as a location for new businesses and the expansion of existing businesses; and WHEREAS, the Public Investment Program (PIP) was established and approved by Lakewood City Council on .lune 2, :1997 as a means for implementing the EDF in order to provide needed and appropriate assistance and support to companies investing in Lakewood that would foster redevelopment efforts to increase jobs, generate new tax revenue and provide for physical improvements in Lakewood; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and :[3 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, to provide for the immediate preservation of the public property, heath and safety, and that it is necessary to conduct a Phase II Environmental Assessment in a timely manner to apply to the Clean Ohio Fund. Now therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section :1. The Council of the City of Lakewood hereby authorizes the use of the Economic Development Fund (EDF) Public Investment Program and to enter into a professional services contract in an amount not to exceed Sixty Thousand Dollars ($60,000.00), with Hull & Associates, Inc. for the purposes of conducting Phase II Environmental Assessment activities on the Hinkley Lighting properties located at :12600 and :12750 Berea Road Lakewood, Ohio, as part of a Clean Ohio Grant Fund application to the State of Ohio; Page 1 of 2
