113.07 WAIVERS. <br /> <br /> Council reserves the right to waive the requirements of this Chapter upon <br />a finding and determination that it is in the best interests of the City; for <br />example, when the City has declared an emergency due to natural disasters and <br />needs immediate services. <br /> <br /> Waivers from the Chapter are disfavored, and will be granted only where <br />the balance of the competing interests weighs clearly in favor of granting the <br />waiver. If waivers are to be granted, partial waivers are favored over blanket <br />waivers. Moreover, any waiver shall not be granted for no more than one year. <br /> <br />113.08 EVALUATION. <br /> <br /> After a three (3) year period from the effective date of this ordinance, an <br />evaluation on the impact of this ordinance shall be done. The Mayor, City <br />Council and the FEWB shall decide on who shall perform the evaluation and the <br />scope of the evaluation. After one (1) year following the effective date of this <br />ordinance, Lakewood City Council shall hold a hearing for the purpose of <br />reviewing this legislation. <br /> <br />113.09 SEVERABILITY. <br /> <br /> In the event any provision of this Chapter is held unconstitutional or <br />invalid or unenforceable by any court of competent jurisdiction, such holding <br />shall not invalidate or render unenforceable any other provision hereof. <br /> <br />113.10 EFFECTIVE DATE. <br /> <br /> The Fair Employment Wage Ordinance shall be effective on February 1, <br />2004. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br />Adopted:. ~ )-/~ 2~ a ~ <br /> <br />Approved o~,, ~ ~ <br /> <br />PRESIDENT <br /> <br /> <br />
