BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> SECTION 1. The agreement between the City and the Lakewood City School District, <br />in the form presently on file with the Clerk of Council, providing for, among other things, payments <br />by the City to the School District compensating the School District for tax revenue the School <br />District would have received had property comprising a Project not been exempted from taxation <br />by the City, is hereby approved and authorized with changes thereto not inconsistent with this <br />Ordinance and not substantially adverse to the City, and which shall be approved by the Director <br />of Law. The Mayor or her designee, alone or together, for and in the name of this City, are hereby <br />authorized to execute that Agreement, and the approval of changes thereto by the Director of Law <br />and the character of those changes as not being substantially adverse to the City shall be <br />evidenced conclusively by their execution thereof. <br /> <br /> SECTION 2. This Council, for and on behalf of the City, hereby waives the <br />requirement in Section 725.02 that the School District notify the City not less than fourteen (14) <br />days prior to the passage of the ordinance authorizing the Development Agreement of the School <br />District's approval of the tax exemption granted by the Development Agreement pursuant to said <br />Section 72:5.02 and determines that the response of the School District shall be taken into account <br />as if it were received within the fourteen (14) day time period provided in said Section 725.02. <br /> <br />" sECTION 3. It is hereby found and determined that all formal actions of this Council <br />concerning and relating to the passage of this Ordinance were passed in open meetings of this <br />Council, and that all such deliberations of this Council and of any of its committees that resulted in <br />any such formal action, were in meetings open to the public, in compliance with all legal <br />requirements including the City's Charter and Codified Ordinances. <br /> <br /> SECT:ION 4. This Ordinance is hereby declared to be an emergency measure <br />necessary for the reasons set forth and defined in the preamble to this Ordinance, and provided it <br />receives the affirmative vote of at least five (5) of its members elected to Council, this Ordinance <br />shall take effect and be in force immediately upon its passage by the Council and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law. <br /> <br />Adopted :'~,~ <br /> <br />President <br /> <br />Page 2 of 2 <br /> <br /> <br />
