ORDINANCE NO~ 45-03 <br /> <br />BY: <br /> <br />Corrigan, Dever, Dunn, <br />George, Roth, Seelie. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Coundl President, with. the <br />concurrence of the majority of Council, to engage an independent negotiator to provide <br />professional services as required by the Development Agreement relating to the West End <br />Redevelopment Area in the City of Lakewood, in accordance with the Administrative Code of <br />the City of Lakewood, contracts not to exceed the specified amounts shown without separate <br />resolution of Council. <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in ART/CLE IH, SECTONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary to provide <br />for the usual daily operation of munidpal departments in that the Ordinance is necessary to <br />comply with the Development Agreement relating to the West End Redevelopment Area. Now <br />therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the President 6f Council, with the concurrence of the majority of <br />Council, is hereby authorized to engage an independent negotiator to provide professional <br />services as required by the Development Agreement relating to the West End Redevelopment <br />Area in the City of Lakewood, in accordance With the Administrative Code of the City of <br />Lakewood, contracts not to exceed the specified amounts shown, except as hereinafter <br />provided: <br /> <br />Professional Services/Proposed West End Development Project $10,000 <br /> <br /> Section 2. That the Council President is hereby authorized and directed to enter <br />into contracts as set forth above in amounts not to exceed the specified amounts without <br />further action from Council; and to enter into contracts in excess of spedfied amounts only <br />upon consent of Council evidenced by adoption of a resolution specifying the authorized <br />amount. <br /> <br /> Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting of <br />this Council, and that all such deliberations of this Council and of any of its committees that <br />resulted in such formal action were in meetings open to the public in compliance with all legal <br />requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency measure for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it receives <br />the affirmative vote of at least five (5) of its members elected to Council, this ordinance shall <br />take effect and be in force immediately upon its adoption by the Council and approval by the <br />Mayor otherwise, it shall take effect and be in force after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />I~esident of Council <br /> <br />Mayor / <br /> <br /> <br />
