ORDINANCE NO: <br /> <br />46-03 BY: Corrigan, Dever, Dunn., <br /> George~, Roth, Seelie. <br /> <br /> AN EMERGENCY ORDINANCE to establish additional appropriations for current expenses <br />and other expenditures of the City of Lakewood, State of Ohio, for the fiscal year ending <br />December 31, 2003 for the purpose of'hiring an independent negotiator as required by the <br />Development Agreement relating to the West End Redevelopment Area in the City of <br />Lakewood. <br /> <br /> WHEREAS, this Coundl by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that 'this ordinance shall take <br />effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CITY OF LAKEVVOOD, and that it is necessary for the <br />immediate preservation of the public property, health and safety~ and to provide for the usual <br />daily operation of municipal departments in that this Ordinance is necessary to comply with the <br />Development Agreement relating to the West End Redevelopment Area. Now Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That Director or Finance is hereby authorized and director to <br />increase appropriations in the following funds by the amount stated below: <br /> <br />GenemlFund <br /> <br />$10,000 <br /> <br /> Section 2. That the Director of Finance is hereby authorized to draw checks <br />upon the City depositories for the amounts appropriated in this ordinance whenever <br />claims are presented, properly approved by the head of the department for which the <br />indebtedness is incurred, providing the President of Council or his/her designees shall <br />approve all claims of the City Council. <br /> <br /> Section 3. It is found and determined that all formal aCtions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Coundl and of any of its committees, that resulted in such formal <br />actions, were in meetings open to the public in compliance with all legal requirements. <br /> <br /> Section ~,. That this ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety and <br />welfare in the City and for the usual daily operaUon of the City for the reasons set forth and <br />defined in the preamble to this ordinance, and provided it receives the affirmative vote of at <br />least five (5) of its members elected to Council, this ordinance shall take effect and be in force <br />immediately upon its adoption by the <br />Council and approval by the Mayor otherwise, it shall take effect and be in force after the <br />eadiest period allowed by law. <br /> <br />Adopted: <br /> <br />President of Council <br /> <br />Approved: '~'~ A~,~ "~ / <br /> <br />Clerk of Council <br /> <br />Mayor <br /> <br /> <br />
