The Clerk of this Council is instructed to file a certified copy of the instant Ordinance, <br />together with Ordinance No. 38-03, and the proposed form of the ballot question with the County <br />Board of Elections by August 21, 2003, the 75t~ day prior to the November 4th, 2003 general <br />election. <br /> <br /> If a majority of the voters vote "For the Ordinance, '~ Ordinance 38-03 passes and the <br />referendum is defeated. If a majority of the voters vote "Against the Ordinance," Ordinance 38-03 <br />shall be deemed repealed. Article XXI, Section 8. A tie-vote results in the issue being defeated. <br />ORC 731.28, 731.29. Upon passage, the effective date of the referendum is five days after the <br />day on which the Board of Elections certifies the official vote on the question. ORC 731.31. <br /> <br /> Section 3. That if the majority of electors vote "For the Ordinance," approving <br />Ordinance No. 38-03 authorizing the adoption of the Development Agreement related to the West <br />End Redevelopment Project, it shall become effective five days after the day on which the Board <br />of Elections certifies the official vote on the question. ORC 731.31. <br /> <br /> Section 4. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the punic in compliance with all Iegal requirements. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency measure <br />necessary for the mediate preservation of the public peace, property, health, safety and welfare <br />in the City and for the usual daily operation of the City for the reasons set forth and defined in the <br />preamble to this ordinance, and provided it receives the affirmative vote of at Ieast five (5) of its <br />members elected to Council, this ordinance shall take effect and be in force immedi~ely upon its <br />adoption by the Council and approval by the Mayor otherwise, it shall take effect and be in force <br />after the earliest period allowed by law. <br /> <br />Adopted: ~_~ ~a;~,, ?~./)~[ O{J ~ <br /> <br />Approved: <br /> <br />MAYOR <br /> <br /> <br />
