ORDINANCE NO. 63-03 FitzGerald, George, Roth, Seelie. AN EMERGENCY ORDINANCE authorizing the Director of Pubtic Works to enter into contracts for an amount not to exceed Sixty Thousand Dollars ($60,000) and declaring said contracts to be necessary to meet an emergency arising with the operation and maintenance of the City sewer system located on Summit Avenue at the intersection of Clifton Boulevard. WHEREAS, approximately 20 feet of City sanitary sewer located below Summit Avenue at the intersection of Clifton Boulevard has collapsed; and WHEREAS, immediate action ismecessary to prevent homes Summit Avenue from being cut off from the City's sanitary sewer system; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEVVOOD, and that it is neceasa~y for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of munidpal departments in that the provision of sewer services to residents on Belle Avenue will not be poSSible without immediate intervention. Now Therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Director of Public Works is hereby authorized to enter into contracts for an amount not to exceed Sixty Thousand Dollars ($60,000) for the repair and/or replacement of the City owned sewer below Summit Avenue at the intersection of Clifton Boulevard as may be necessary. Section 2. This Council hereby declares said contracts to be necessary to meet an emergency arising with the operation and maintenance of the City sewer system located below Summit Avenue, pursuant to Lakewood Codified Ordinance §111.04(a)(3). Section 3. It is found and determined that all formal actions of this Coundl concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with ail legal requirements. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its members elected to Council, this
