<br />ORDINANCE NO: <br /> <br />105-04 <br /> <br />BY: Corrigan, Dever, <br />FitzGerald, Madigan, Seelie. <br /> <br />AN ORDINANCE amending Section 121.18 of the Codified Ordinances of the City of <br />Lakewood to change the mandatory rules concerning reports from Council Committees. <br /> <br />WHEREAS, this Council has authority over its own rules of operations and has regularly <br />reformed or amended those rules to conform with established practices or improve its means of <br />operations; <br /> <br />WHEREAS, this Council made a series of changes in 1974 by adopting Ordinance No. 63-74, <br />including the present form of Section 121.18 Reports of Committees; <br /> <br />WHEREAS, without limiting its power to direct its Committees to meet specific timetables or <br />otherwise report in specific format, the Council over time has largely omitted strict compliance with <br />the "third next regular" and "each second subsequent regular meeting" provisions of Section <br />121.18 Reports of Committees and permitted cthe Clerk's scheduling and posting documents to <br />serve those purposes; , <br /> <br />WHEREAS, it is desirable to amend Section 121.18 to conform with current practice and to <br />revise mandatory provisions that have not been treated as such; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected hereto determines <br />that this ordinance is an emergency measure, and that this ordinance shali take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED <br />CHARTER OF THE cm OF LAKEWOOD, and that immediate action is necessary to provide for the <br />immediate reform of the operations and rules of Council. NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE cm OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 121.18 of the Codified Ordinances of the City of Lakewood, <br />adopted as part of Ordinance No. 63-74, passed September 16, 1974, and reproduced in its <br />entirety herein: <br /> <br />121.18 REPORTS OF COMMITTEES. <br />The committee to which any ordinancel resolution petition or other matter has been referred for <br />consideraüon shall report to Councii the status of such referral by the third next regular Council <br />meeting from such reference and at each second subsequent regular meeting thereafter until final <br />report. Such status report shaii be given by the chairman of the committee and may be either orai <br />or wrítten. <br /> <br />be and hereby is amended to: <br /> <br />121.18 REPORTS OF COMMITTEES. <br />The committee to which any ordinance, resolution, petitíon or other matter has been referred for <br />consideration may report to Councii on the status of such referrai as often as the committee or its <br />chairman determine is necessary prior to a final report on the referral is ready. This section shail not <br />be construed to limit the ability of Councilor its members to move to discharge tram committee any <br />referral or to mòve to reconsider the referral at the next regular Council meeting from such <br />reference. Any status reports shail be given by the chairman of the committee and may be either <br />oral or wrítten. <br /> <br />Section 2. It is found and detérmined that all formal actions of this Council concerning <br />and relating to the passage of this Ordinance were adopted in an open meeting of this Councii, <br />and that all such deliberations of this Council and any of its committees that resulted in such <br />formal actions, were in meetings open to the public in compliance with ali legål requirements: <br />
