PLACED ON 2ND READING 4/19/04. <br /> <br /> ORDINANCE NO. 43-04 BY: Corrigan, Demro, Dever, Dtmn, <br /> <br /> FitzGerald, Madigan, Seelie. <br />to AN EMERGENCY ORDINANCE author zing and directing the D rector of Finance <br /> Sell through public auctions, various obsolete, surplus and non-functioning City <br />vehicles, materials and/or equipment, <br /> <br /> WHEREAS, it is in the best interest of the City to sell this obsolete, surplus and <br />non-functioning equipment to make better use of the space it occupies and to realize a <br />profit from the sale, and <br /> <br /> WHEREAS, this Council by an affirmative vote of at least five (5) members <br />elected thereto determines that this ordinance is an emergency measure, and that this <br />ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, <br />SECTIQNS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it provides for the usual daily operation of municipal departments <br />in that it is in the best interest of the City to Auction obsolete equipment due to lack of <br />physical storage at City Hall and delivery of new equipment, now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and he is hereby authorized and <br />directed to sell, through public auctions, held in the spring and the fall, various obsolete, <br />surplus and non-functioning City vehicles, materials and/or equipment after advertising <br />according to <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relafing to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, Were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br /> Section 3. This ordinance is hereby declared to be an emergency measure <br />necessary for the daily operation of municipal departments in the City for the reasons set <br />fodh in the preamble to this ordinance, and provided it received the affirmative vote of at <br />least five (5) of its members elected to Council, this ordinance shall take effect and be in <br />force immediately upon its adoption by the Council and approval by the Mayor <br />otherwise, it shall take effect and be in force after the eadiest period allowed by law <br /> <br /> <br />
