<br />(e) Every owner or person in charge or control of a female dog shall, during <br />all times when such female dog is in heat, either confine such dog indoors or treat her <br />in such manner ¡Is not to attract other dogs. <br /> <br />(f) (1) Whoever violates any provision of this section is guilty of a <br />minor misdemeanor for a first offense. <br />(2) WhOever violates any provision of this section in a second or <br />subsequent offense shall be guilty of a misdemeanor of the fourth <br />degree. <br /> <br />505.03 IMPOUNDING AND DISPOSITION; RECORDS. <br />A police officer or the Animal Warden shall impound every dog and the Animal <br />Warden shall impound every cat fbund in violation of Section 505.02. <br />(a) If the impounded dog is not wearing a valid registration tag, the dog shall <br />forthwith be turned over to an officer charged by law with the custody <br />and disposal of such dogs. If the dog is wearing a valid registration tag or <br />the identity of the owner or harborer is otherwise established, notice shall <br />be given prior to or pn the next working day to such owner or harborer <br />that the dog has been impounded. Notice may be by telephone or by <br />residence service to the last known address of such owner or harborer. <br />The dog shall not be released except upon the payment of the following <br />charges: for impounding any dog, five. dollars ($5.00); for giving notice, <br />five dollars ($5.00); for Keeping any dog, six dollars ($6.00) per day. Any <br />dog not redeemed by the next working day after notice, as herein <br />provided, is given to the owner or harborer, or the next working day <br />following the date it is seized or impounded if the owner or harborer <br />cannot be found, may be sold or otherwise disposed of as provided in <br />Ohio R.C. 955.16. <br />(b) If the impounded c¡lt is wearing an identification tag or the identity of the <br />owner or harborer is otherwise established, notice shall be given within <br />two days to such owner or harborer that the cat has been impounded. <br />Notice may be by telephone or by residence service to the last known <br />address of such owner or harborer. The cat shall not be released except <br />upon the payment of the following charges: for impounding any cat, five <br />dollars ($5.00); for keeping any cat, five dollars ($5.00) per day. Any cat <br />not redeemed within three days after notice is given to the owner or <br />harborer as provided herein, or within three days of the time such cat is <br />seized or impounded, if the owner or harborer cannot be found, f11ay be <br />sold or otherwise disposed of in a humane manner as shall be determined <br />by the Animal Warden. <br />(c) A record of all dogs and cats impounded, the dISP. osition of the same, the <br />owner's name and address, if known, and a statement of any costs or <br />receipts involving such dO$} or c<\t shall be kept. <br /> <br />505.04 ANNUAL REGISTRATION OF DOGS; TAGS REQUXRED. <br />(a) Except for guide, leader or listener dogs, or dogs in training to become <br />guide, leader or listener dogs, registered under Ohio R.C. 955.011, and dogs kept by an <br />institution or organization for teaching and research purposes under Ohio R.C. 955.16, <br />no person shali own, keep or harbor a dog mOre than three months of age without <br />annualiy registering such dog with the County Auditor. Failure of any dog at any time to <br />wear a valid registration tag shall be prima-facie evidence of lack of registration and <br />subject such dog to impounding and disposition as provided by Ohio R.C. 955.16. <br /> <br />(b) . No person shali own, keep or harbor a dog wearing a fictitious, altered or <br />invalid registration tag or a registration tag not issued by the County Auditor In <br />connection with the registration of such animal. <br /> <br />(c) Whoever violates this section is guilty of a minor misdemeanor. <br /> <br />505.05 HINDERING CAPTURE OF UNLICENSED QOG. <br />. (a) No person shall obstruct or interfere with anyone lawfully engaged in <br />capturing an unlicensed dog or making an examination of a dog wearing a tag. <br /> <br />(b) Whoever violates this section is guilty of a minor misdemeanor. <br /> <br />505.06 ABANDONXNG ANIMALS. <br />(a) No owner or keeper of a dog, cat or óther domestic animal shall abandon <br />such animal. . <br /> <br />(b) Whoever violates this section is guilty of a minor misdemeanor. <br />
