AN EMERGENCY ORDINANCE to authorize the Mayor to make applicsUon to the Cuyahoga County Board of Commissioners for approval to use County Motor Vehicle License Tax Funds for the improvement of Berea Road (CR-309) from ~the Lakewood WCL to the Lakewood ECL and to enter into an agreement with Cuyahoga County necessary to complete the planning and construction of this improvement. WHEREAS, the City of Lakewood recognizes the need for and proposes the improvement of a portion of public highway described as follows: The repair and resurfacing of Berea Road (CR-309) from the Lakewood WCL to the Lakewood ECL. WHEREAS, this project is part of a larger project which is the repair and resurfacing of Berea Road (CR-309) from Triskett Road to Detroit Avenue in the Cities of Cleveland and Lakewood; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE zII, SECTONS 10 and 13 of'the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this legislation is necessaw to complete the Berea Road reconstruction project. Now Therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. A. CONSENT 1. It is declared to be in the public interest that the consent of the City of Lakewood be and such consent is hereby given to the County to construct the above described improvement in accordance with plans specifications and estimates approved by the County. COOPEPJ~TION 1. That the County and the City of Lakewood will cooperate in the repair and resurfacing of Berea Road (CR-309) from Lakewood WCL to Lakewood ECL. 2. That the County will prepare construction plans and specifications, including necessary engineering reports for improvement, under current Cuyahoga County standards for construction of County roads and bridges. 3. That the County will arrange for the supervision and administration of the construction contract. C, FUNDING
