3. Rent. <br /> 3.1 <br />($1.00) per year. <br /> 3.2 <br />year of the Terrn~ <br />3.3 <br />Lakewood City Hall. <br /> <br />BOARD shall pay CITY as rent the amount of ONE DOLLAR <br /> <br />Rent shall be due and payable on or before the first day of each <br /> <br />BOARD shall pay rent at CITY's principal place of business, <br /> <br />agrees that: <br /> <br />Premises; <br /> <br />BOARD's Covenants. BOARD hereby represents, covenants, and <br />4.1 BOARD Will not commit or suffer any waste upon the Leased <br />4.2 BOARD shall occupy and use the Leased Premises only for the <br /> <br />operation of a public swimming pool and related activities and shall comply with all <br />reasonable rules and regulations promulgated by CITY applicable to public buildings and <br />parks of which the Leased Premises are a part; <br /> 4.3 BOARD Will not use the Leased Premises (or permit the Leased <br />Premises to be used) for any unlawful purpose and will conform to, comply With and obey <br />all present and future Federal, State and local laws, ordinances, roles and regulations <br />applicable to the Leased Premises and BOARD's occupation and use thereof; <br /> 4.4 BOARD shall make no alteration or additions (includ'mg signs) in, to <br />or on the Leased Premises without CITY's prior written consent; <br /> 4.5 Without CITY's prior written consent, BOARD shall do none of the <br />following: assign this Lease or any part of it; sublet the Leased Premises or any part of it or <br />grant any licenses With respect to the Leased Premises or any part of it, or attempt to do any <br />of the foregoing; <br /> 4.6 BOARD will permit CITY to enter upon and examine the Leased <br />Premises at all reasonable times in order to repair, maintain, or improve it (as required by <br />the Pool Agreement), to inspect it, and any other reason that CITY reasonably deems <br />necessary or appropriate. Any such activity by CITY shall not be a breach of this Lease by <br />CITY and CITY shall not, in such events, be liable to BOARD for any damages <br />whatsoever; <br /> <br /> 5. CITY's Covenants. CITY hereby represents, warrants, covenants and <br />agrees that: <br /> 5.1 During the Term, BOARD shall peaceably and quietly hold, occupy, <br />and enjoy the Leased Premises Without let, hindrance or molestation by CITY or any other <br />person or persons chiming lawfully under the CITY; <br /> 5.2 CITY has good right and full power to let, lease and demise the <br />Leased Premises in accordance With this Lease; <br /> 5~3 CITY shall be responsible for and shall pay all utilities <br />services consumed on the Leased Premises and all utilities shall be placed in CITY's name; <br /> 5.4 CITY shall be responsible for and shall pay all real estate taxes and <br />all assessments (whether general or special) with respect to the Leased Premises for which <br />the parties are not exempt; <br /> <br />2 <br /> <br /> <br />
