<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />SECTION 1 The agreement between the City and the Lakewood City School <br />District, in the form presently on file with the Clerk of Council, providing for, among <br />other things, payments by the City to the School District compensating the School <br />District for tax revenue the School District would have received had property <br />comprising the Project not been exempted from taxation by the City, is hereby <br />approved and authorized with changes thereto not inconsistent with this Ordinance <br />and not substantially adverse to the City. and which shall be approved by the <br />Director of Law, The Mayor or his Oesignee, alone or together, for and in the name <br />of this City, are hereby authorized to execute that Agreement, and the approval of <br />changes thereto by the Director of Law and the character of those changes as not <br />being substantially adverse to the City shall be evidenced conclusively by their <br />execution thereof <br /> <br />SECTION 2, This Council, for and on behalf of the City, hereby waives the <br />requirement in Section 5709.40 that the School District notify the City not less than <br />fourteen (14) days prior to the passage of the ordinance authorizing the <br />Development Agreement of the School District's approval of the tax exemption <br />granted by the Development Agreement pursuant to said Section 5709.40 and <br />determines that the response of the School District shall be taken into account as if it <br />were received within the fourteen (14) daytime period provided in said Section <br />5709.40 <br /> <br />SECTION 3" It is hereby found and determined that all formal actions of this <br />Council concerning and relating to the passage of this Oroinance were passed in <br />open meetings of this Council, and that all such deliberations of this Council and of <br />any of its committees that resulted in any such formal action, were in meetings open <br />to the public, in compliance with all legal requirements including the City's Charter <br />and Codified Ordinances, <br /> <br />SECTION 4 This Ordinance is hereby declared to be an emergency <br />measure necessary for the reasons set forth and defined in the preamble to this <br />Ordinance, and provided it receives the affirmative vote of at least five (5) of its <br />members elected to Council, this Ordinance shall take effect and be in force <br />immediately upon its passage by the Council and approval by the Mayor; otherwise, <br />it shall take effect and be in force after the earliest period allowed by law <br /> <br />Adopted: <br /> <br />~ 7, 2</ð'1 <br />iê~.
