<br />"Debt Service" means (a) the principal of, any premium, and interest on Bonds, (b) any <br />amount paid under any interest rate hedging or protection agreement in lieu of paying principal, <br />interest or premium, (c) any charges of any bond 1rustee, credit enhancement provider, or <br />remarketing agent, and (d) other amounts customarily paid as annual charges for obligations such <br />as the Bonds, except for deposits to reserve funds. <br /> <br />"Improvements" has the meaning given such tenn in Division (A)( 4) of Section 5709.40 <br />of the Ohio Revised Code and specifically means the increase in assessed value of Property first <br />appearing on the tax list and duplicate of real and public utility property after the effective date <br />ofthe TIP Ordinance. The tenn does not include any Public Improvement. <br /> <br />"Incentive District" means the "Detroit A venuelRockport Square Incentive District" as <br />described and designated in the TIP Ordinance. <br /> <br />"Project" means the new mixed-use residential and commercial project called the <br />"Rockport Square Revitalization Project," located on the Property. <br /> <br />"Property" means the real and public utility property located within the Incentive District <br />designated in the TIP Ordinance. <br /> <br />"Property Taxes" means real and public utility property taxes, including any associated <br />interest and penalties, and any rollback, homestead or personal property tax makeup payments <br />under Revised Code Sections 321.24 and 323.156, or any similar payments. <br /> <br />"Public Improvements" means public infras1ructure improvements of the City with <br />respect to the Incentive District, as more specifically described in Exhibit C to the TIP <br />Ordinance. <br /> <br />"Qualified Reserve Fund" means (a) any debt service reserve fund for assuring the <br />payment of Debt Service, established under any 1rust agreement or indenture securing the <br />payment of the Bonds, (b) a capital improvements reserve fund established in connection with <br />any Public Improvement, and (c) any other reserve fund approved by the School District as <br />provided in Section 4( d)(3). <br /> <br />"Required Reserve Deposit" means all amounts requITed to be deposited to any Qualified <br />Reserve Fund. <br /> <br />"School District Income Tax" means a tax on income levied under Chapter 5748, Revised <br />Code, or any other present or future Ohio law authorizing a tax on incomes for school district <br />purposes. <br /> <br />"Service Payments" means the service payments in lieu of taxes imposed under the TIP <br />Ordinance on Improvements on the Property, in accordance with Section 5709.42 of the Ohio <br />Revised Code. <br /> <br />2 <br />
