ORDINANCE NO' 54-04 BY: AN EMERGENCY ORDINANCE to establish additional appropriations for current expenses and other expenditures of the City of Lakewood, State of Ohio, for the fiscal year ending December 31, 2004, WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordioance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this Ordinance is necessary to complete projects planned for the year 2004. Now Therefore, BE IT ORDAINED BY THE CITY OF L,AKEWOOD, STATE OF OHIO Section 1 That Director or Finance is hereby authorized and director to increase appropriations in the following funds by the amount stated below: Waatewater Improvement Fund $200,000 Section 2. That the Director of Finance is hereby authorized to draw checks upon the City depositories for the amounts appropriated in this ordinance whenever claims are presented, properly approved by the head of the department for which the indebtedness is incurred, providing the President of Council or his/her designees shall approve ail claims of the City Council Section 3. In accordance with Article III, Secfi~n 12, of the Charter of the City of Lakewood, Council hereby determines that the manner of giving notice of the passage of this ordinance is to be by posting copies hereof for a pedod of not less than fifteen (15) days in not less than five (5) of the most public places in the City, which places have been determined by Council in Ordinance No. 55-59. Section 4. It is found and determined thai all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and of any of its committees, that resulted in such formal actions, were in meetings open to the public in compliance with ali legal requirements. Section 5 That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation ofthe public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its members elected to Council, this ordinance shall take effect and be in fome immediately upon its adoption by the Council and approval by the Mayor otherwise, it shall take effect and be in rome after the eadiest pedod allowed by law.
